After investigation and inspection the Board finds that
applicant requests permission to construct one family dwelling
with insufficient width and setbacks on property located on
the north side of Sound View Avenue, Southold. The findings
of the Board are that this property is within 500 feet of the
County Road, and about 40 feet to the water's edge. This is
a very limited piece of property in regard to size and
topography. The Board also finds that applicant has not
submitted a plot plan of the property showing the exact
proposed location of the proposed dwelling or exact variances
with reference to specific sections of the Zoning Ordinance.
The Board finds that strict application of the Ordinance
would not produce practical difficulties or unnecessary
hardship; the hardship created is not unique, and would be
shared by all properties alike in the immediate vicinity of
this property and in the same use district; and the variance
will change the character of the neighborhood, and will not
observe the spirit of the Ordinance.
THEREFORE IT WAS RESOLVED, Rudolph H. Bruer, Esq. a/c
William Herman, 11 Levon Lane, Miller Place, N. Y. be DENIED
permission to construct one family dwelling with insufficient
width and setbacks on property located on the north side of
Sound View Avenue, Southold, as applied for. This denial is
made without prejudice to future applications.

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because a one family dwelling can onl~ be constructed if a
variance is granted otherwise the p~operty can only be used as a beach.
2. The hardship createdis UNIQUE and is notshared by all prope~ies alike in the immediate
vicinity ofthis prope~y and in this use district bemuse most properties in this area
are improved with dwellings including one motel. The exception
is the adjacent properties one of which is used for the motel's
beach.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the property in this area was subdivided
prior to zoning. All lots in this area ar~, small in character.

reason that this application was unable to be reviewed
by the Suffolk County Planning Cor~ission because of
incomplete information and maps".
The Suffolk County Planning Commission is requiring
that exact variances be specified to with reference to

Any oonstruotion will have to be proteotnd by heavy bulkheading or s~lar
ty~ oonstr~tion. Other houses in this area are now undermined by storms
and are either shored up on piling or collapsing of their own weight.
