The findings of the Board are that the partial side yard area is the best possible lo=ation for an accessory building. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. On motion by Mr. Gillispie, seconded by Mr. Hulse, it was RESOLVED William Killian & Wife, Pvt. R.O.W. off West Mill Road, Mattituck, New York be GRANTED permission to construct accessory building in partial side yard area, as applied for on property located on Private R.O.W. off West Mill Road, Mattituck, New York. REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 (3:) A Variance to the Zoning Ordinance ( ) is requested for the reason that : Topography of lot ~ill not permit accessory builditt~_ in lc§al rear yard~ this lot slopes sharply tward the east. Form ZB1 (Continue on other side) REASON FOR APPEAL O Continued 0 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sar,j .H. ARDSHIP because A~ we u~derstaud it, a building must be at least 35 feet from a "Right of Way.? ~he "Right of Way" rums pact our back yard. D~e to the ilepe of our property is this area the only level land im the property that is adjacemt to the "Right of Way". The~e is~'~ mufficiemt space im that area, because of the 35' limitation to build a l0t X 10~ Accessory Building. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because ~l~ere are no other residemt~iul str~otures adjacent or bordermmg the "Right of Way". Therefore no other property owner im the immediate area has this problem. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because The bu~Zl.a~$ proposed is only a ~m~ulZ, pre- fabricated metal structure. The type that is used on mmay existisg properties throughout the ~owae which are used to house lawn mowers; rake~i hoses; shovels, amd similiar household amd garde~ equipmemt. The building would set on a small plateu below the level of the front part of the house. It is am area that is isolated from amy m~arby remide~ce~ or mearby busimemses. It has tree coverage al~o. Its location ca~ only be ~ee~ slearl~ from our own front wimdows. The nearest residemce is approximately ~ to ~ miles from the ~oposed bui]a~-g mite. It must be noted that the front of our house looks out om the Mattituck Inlet. The shape of the la~d plus the fact that most of the lamd directly im front of our house is also our p~operty, prehibts the possibility of auy future building in that area.
