VARIANCE. FORM ZB4 SEE REVERSE APPROVED ~~erm~ot~t~v Secretary After investigation and inspection the Board finds that applicant requests permission to divide lots with insufficient area on Oaklawn Avenue - Jockey Creek Drive, SouthOld. The findings of the Board are that applicant's home lot and the lot to be created are larger than most other lots in the area. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will ~bserve the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Lefferts P. Continued REASON FOR APPEAL 1. STRICT APPLICATION OF THE ORDINANCE would produce practicaldifficulti~ orunneces- sary HARDSHIPbecau~ prior errors in conveyancing which resulted in the merger of that part of the property on Oaklawn Avenue with that part of the property located on Jockey Creek Drive result in the applicants having but one lot whereas their intention was to have their home lot on Oaklawn Avenue and an additional lot on Jockey Creek Drive as an investment. 2. The hardshipcreatedis UNIQUE andisnotshared by all prope~ies alike in the immediate vicini~ ofthisproperty and in this use district bemuse the property as now constituted, because of the frontage on two streets, would properly accommodate two homes. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the home lot on OaklawnAvenue would be left unchanged, with more square footage than when it was purchased in 1965. The lot on Jockey Creek Drive being 31,536 square feet, would properly accommodate a dwelling which would conform with the other lots on Jockey Creek Drive. EDSON, residing at Main Road, Southold, New York, being duly sworn, deposes and says: The following constitutes a chronological statement of the conveyancing done for Dr. Robert T. Kroepel in his purchase of three parcels of land, one on Oaklawn Avenue and two on Jockey Creek Drive which were made with the intention of providing him with a home and dental office on Oaklawn Avenue and an additional lot on Jockey Creek Drive the purchase of which was for investment purposes. Prior to the marriage of Dr. Kroepel to his wife, Virginia W. Kroepel, Dr. Kroepel purchased the Oaklawn Avenue building lot with his mother because of his impending military commitment. Dr.i Kroepel thereafter married and purchased a parcel of land from the Clasing estate on Jockey Creek Drive together with his wife, Virginia W. Kroepel. Dr. Kroepel at that time had an interest in two valid lots. Next Dr. Kroepel built his home and office on the Oaklawn Avenue parcel in connection with which he obtained a mortgage loan which necessitated transferring the ownership of his mother in the Oaklawn Avenue parcel to his wife~ Virginia. At that time a merger occurred because the form of the ownership of the Jockey Creek Drive lot was not changed simultaneously therewith to retain the separate identities of the lots. At a later date in order to comply with present zoning Dr. Kroepel bought an additional 70 feet on Jockey Creek Drive on the westerly side of his existing parcel to create a lot containing 40,000 square feet: During his period of residence he installed a swimming pool in the back of his dwelling a part of which encroaches on the land of his Jockey Creek Drive lot. In light of the above Dro Kroepel now applies for a separat- ion of all of this land into two parcels as sho%n~ on the attached survey. The home lot is enlarged from one-half acre to 28,529 square feet and the remaining land on Jockey Creek Drive having 31~536 square feet. This would accommodate his home and swimming pool on one lot and leave the vacant Jockey Creek Drive lot of a s~ze that conforms with other lots in the area.
