Location of property: Lot Nos. 117 and 118, Map of Captain Kidd Estates, Central & Inlet Drives, Mattituck, N. Y. Fee paid $15.00. 2. VARI/%NCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. The findings of the Board are that applicant is surrounded by similar size lots in the Captain Kidd Estates subdivision, and it would be a hardship to the applicant if the Board were to deny this application; a denial would not be supported by the area. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, William J. Clark, Esq. a/c Theofanis Kyvernitis, 17 Sound Beach Drive, Mattituck, New York, be GRANTED permission to divide property with insufficient area and width, Lots ~117 and 9118, Map of Captain Kidd Estates, Central and Inlet Drives, Mattituck, New York, as applied for. STRICT APPLICATION OF THE ORDINANCE would produce practicaldifficultiesorunneces- sob HARDSHIPbecause the upkeep and maintainanae of the uninproved lots would create a burden to the owners as they are retired and intend to offer the lots for sale. 2. The hardship crea~dis UNIQUEandisnotshared by all prope~ies alike in the immediate vicinity ofthisprope~y and in this use district because the unimproved lots have no economic value unless they are divided into separate units. All three lots were originally in single and separate ownership. They were purchased by the present owners individually at various times; to wit lot 1J6-July 1963,.lot 117-October 1958 and 118-January 1957. Each lot has a frontage of 90 feet. The surrounding lots in the area vary in size~from 90 feet to 103 feet. 3. The Variance would obse~e the spirit ofthe O~inance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because many one-family dwellings are now on 90 foot lots and granting the variance would comply with the or- iginal scheme of the development and would not adversely affect the public safety, health or welfare of the community.
