After investigation and inspection the Board finds that
applicant requests permission to divide lot with existing
buildings on the south side of Bay Avenue, East Marion,
New York. The findings of the Board are that there will
be no change in the character of the neighborhood, that
this division of property will recognize an existing
situation. The Board agrees with the reasoning of the
applicant.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property
and in the same use district; and the variance will not
change the character of the neighborhood, and will observe
the spirit of the Ordinance.
THEREFORE IT WAS RESOLVED, Rudolph Bruer, Esq. a/c
Anne C. Lemley, Bay Avenue, East Marion, New York be GRANTED
PERMISSION TO divide lot with existing buildings on the south
side of Bay Avenue, East Marion, New York, as applied for,
subject to the following condition:
That there shall be no further diminution of side

is requested for the reason that

1. STRICT APPLICATION OF THE ORDINANCE would pr~uce pm~icaldifficulti~ orunneces-

Applicant would be restricted to one piece of property having two
existing buildings thereon.
2. The hardship created is UNIQUE and is not shared by oil properties alike in the immediate
vicinity of this property and in this use district because applicant would be unable to
divide her property which has two existing buildings thereon.
3. The VarianCe would obse~e the ~irit ofthe Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT b~au~ no additional residences would be
created. The situation would remain the same since there exists
two residences on this property. If allowed to divide her property
the existing division would conform to the remaining lots and
residences in the area.
