Location of property: South side Bay Avenue, East Marion, New York, bounded on the north by J. Fasio; east by Private R.O.W.; south by Lebrowski and Heroy; west by Bay Avenue. Fee paid $15.00. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties hardship because SEE REVERSE (b) The hardship created (is) (~ not) unique and (would) (would not) be shared by aH properties alike in the immediate vicinRy of th~ property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. The findings of the Board are that there will be no change in the character of the neighborhood, that this division of property will recognize an existing situation. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Rudolph Bruer, Esq. a/c Anne C. Lemley, Bay Avenue, East Marion, New York be GRANTED PERMISSION TO divide lot with existing buildings on the south side of Bay Avenue, East Marion, New York, as applied for, subject to the following condition: That there shall be no further diminution of side and front yards of either of these residences. Applicant would be restricted to one piece of property having two existing buildings thereon. 2. The hardship created is UNIQUE and is not shared by oil properties alike in the immediate vicinity of this property and in this use district because applicant would be unable to divide her property which has two existing buildings thereon. 3.
