(E.D.S.T.) upon application of Michael T. Burke, 155 ~loodcliff Drive, ~attituck, New York for a variance in accordance with the Zoning Ordinance, Article III, Section 100-55 for permission to construct addition ,.ith reduced front yard setback. Location of property: ~est side of Woodcliff Drive, Mattituck, New York, bounded on the north by J.W. Duhno~sky, east by Woodcliff Drive, south by James B. Kaminsky, ~est by D.A. Bucklsy: & Anna Hanssn. Fee paid $ 15. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because SEE REVERSE difficulties or unnecessary (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because SEE REVERSE (would not) and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE FORM ZB4 APPROVED ZONING BOARD OF A~:fPEALS After investigation and inspection'the Board finds'that the applicant proposes to enclose and extend carport to make den or family room, three feet over the minimum required setback of 35 feet in the front yard area. The Board finds that the applicant has s topographical hardship because an addition to the rear ~ould be complicated by the location of several lar9s trees. The 8oard agrees ~ith the reasoning of the applicant. The Board finds that strict application of the Ordinance ~ould produce practical difficulties or unnecessary hardship; the hardship created is unique and ~ould not be shared by all properties alike in the immediate vicinity of this property and in the same uss district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. On motion by Mr. Bergen, seconded by mr. Doyen, it was RESOLVED Michael Burke, 155 ~oodcliff Drive, ~attituck, Ne~ York be GRANTED permission to construct addition ~ith reduced front yard setback as applied for on property located at ~est side of ~oodcliff Drive, ~attituck, New York.
