~ South~ld Town Board of Appeals
After investigation and inspection the Board finds that
the applicant proposes to divide waterfront lot with an area
of 82,000 sq. ft. into two lots. Existing dwelling is located
approximately in the middle of the property, thereby creating
a topographical hardship. The westerly lot to be created will
have only 35,000 sq. ft. and the original owner will have 47,000
sq. ft. of area. The new westerly lot to be created will have
only 65 ft. frontage on the right-of-way which is also due to
the location of the existing dwelling. The Board is of the
opinion that it would be an economic hardship to deny the
division of this property and generally agrees with the
reasoning of the applicant.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property
and in the same use district; and the variance will not change
the character of the neighborhood, and will observe the spirit
of the Ordinance.
On motion by Mr. Gillispie, seconded by Mr. Bergen, it was
RESOLVED Gary Olsen, Attorney a/c Stanley A. Chase, Park
Avenue, Mattituck, New York be GRANTED permission to divide
property with insufficient area and width as applied on property
located on private road off S/S Park Avenue, Mattituck, N.Y.,
subject to the following conditions:
(1)
The division of this property shall be subject to
any covenants of record. There shall be no building
before March of 1979 or whatever date the covenant
of record expires, whichever is later.
(2)
That there be no construction within 30 f~et of the
westerly sideyard and no construction within 10 feet
of any other sideyard.

I. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because the subject premises is oversized. Applicant wishes to
divide the properly into two parcels, one wilh 35, 000 square feet and
the other 47, 000 square feet.
The appl~cant'~o~ld suf~fer unnecessary economic hardship by the
strict application of lhe ordinance parlicularly since the subject
property is bay front and accordingly ~niquety val'uable.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property end in this use district bec~ause the snb;~ect premi~ :TS pz-eseu¢ly
9versz_'ze~, ~having a total_ area of approximately 82,000 Square feet. Due
to the fad~ Chat ~ccess i~ bbtai~ed from a private road located at the
easterly side, the westerly parcel to be created by the proposed division
requires a frontage variance.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the pazeeels would be approximately one acre
each in conformance to the general character of the neighborhood.

Dear Mr. Grigonis:
A public hearing was held by this Board on August 25th
regarding the "grandfathering" of actions taken by the Zoning
Board of Appeals during the period 1971 through 1979 which
did not go before the Planning Board.
At that time there were two complainants in the audience
regarding two of the 337 actions under review. The public
hearing is covered on pages 4, 5 and 6 of the minutes of that
meeting which have been distributed to you.
In the matter of Ms. Winecoff it was discovered that she
was talking about the piece of property adjoining hers when,
in fact, the property being considered in the appeal was across
the street.
In the matter of Peter Hanlon's complaint regarding the
subdivision of Stanley Ch&se, the Planning Board would like to
request that you consider reviewing your action in this matter.
