VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because SEE REVERSE difficulties or unnecessary (b) The hardship created (is) (is not) umque and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because SEE REVERSE (would not) and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be con/irmed ( ) be reversed. SEE REVERSE FORM ZB4 ROVED I~/~'' ~NIiNG BOARD OF APPEALS e e, Secretary Pro Tem ~ South~ld Town Board of Appeals After investigation and inspection the Board finds that the applicant proposes to divide waterfront lot with an area of 82,000 sq. ft. into two lots. Existing dwelling is located approximately in the middle of the property, thereby creating a topographical hardship. The westerly lot to be created will have only 35,000 sq. ft. and the original owner will have 47,000 sq. ft. of area. The new westerly lot to be created will have only 65 ft. frontage on the right-of-way which is also due to the location of the existing dwelling. The Board is of the opinion that it would be an economic hardship to deny the division of this property and generally agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED Gary Olsen, Attorney a/c Stanley A. Chase, Park Avenue, Mattituck, New York be GRANTED permission to divide property with insufficient area and width as applied on property located on private road off S/S Park Avenue, Mattituck, N.Y., subject to the following conditions: (1) The division of this property shall be subject to any covenants of record. There shall be no building before March of 1979 or whatever date the covenant of record expires, whichever is later. (2) That there be no construction within 30 f~et of the westerly sideyard and no construction within 10 feet of any other sideyard.
