Location of property: south side Main Road, East Marion, New York, bounded on the north by Route 25 (Main Road); east by Clara Rackett; south by Marion Lake; west by M. Billman. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because SEE REVERSE practical difficulties or unnecessary (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( that the previous decisions of the Building Inslt~tor ( ) be confirmed ( SEE REVERSE FORM ZB4 ZONING ) be granted ( ) be reversed. BOARD OF APPEALS ) be denied and After investigation and inspection the Board find~ that the applicant requests permission to set off a lot wit] in- sufficient width and area, south side Main Road, East [arion, New York. The findings of the Board are that this is an ap- propriate division of property in this area. Many of the lots are smaller than the ones to be created. ' The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared:by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Louis V. and Ruth L. SChmidtchen, Main Road, East Marion, New York be GRANTED permissionlto set off lot with insufficient width and area, south side Main Road, East Marion, New York, subject to the following condition: The Chairman of the Board of Appeals and the Building Inspector shall inspect the property and confirm in writing that they have done so.
