STRICT APPLICATION OF THE ORDINANCE would produce practicaldifficulti~ orunneces- sary HARDSHIPbecause this is a deep rectangular parcel of land with a large 2 1/2 story residence located on the plot fronting Vanston Road. The house itself was formerly used as an adult summer boarding house and it is where the applicant presently resides with her family. The applicant desires to divide this plot and erect a one family residence on the other lot. The denial by the Building Inspector for a building permit for the other house in essence imposes a three acre zoning on this parcel thereby causing your petitioner a financial hardship in not being able to sell one of the lots. Due to the terrain this parcel can be suitably divided into two large lots which conform to the present zoning requirements as well as the natural contour of the land. 2. The hardshipcreatedis UNIQUEandisnotshared by all properties alike in the immediate vicinity ofthis property and in this use district because your petitioner's property contains 120,000 square feet and the proposed division into two lots one containing 53,200 square feet, and the other containing 66,800 square feet will exceed the building zone ordinance requirements for this use district, which unlike the surrounding lots in the neighbor- hood are primarily nonconforming and contain less than one acre. 3. The Variance would observe the spirit ofthe Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the proposed division contemplates a one family residential use on each of the two proposed lots. After the division the lots will conform in all respects to area, width, depth and side yard requirements of the present building zone ordi- nance; in fact, the lots will be larger than most of the surrounding lots in the general neighborhood and the proposed right-of-way will not create any undue increase in vehicular traffic congestion on Vanston Road.
