1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because lot could not be utilized unless access over
right of way is approved
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because other neighboring properties
are on public road or in open development area.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because lot is 40.000 square feet as required

Dear Sirs:
Re: John Simicich
Upon the advice of my lawyers in New York, I have to
inform the Southold Town Board of Appeals that I have received
the notice of the variance application.
My main concern if the application is granted is that
Camp Mineola Road, which I have paved at my own expense adjoining
my property will be ruined by the construction truck traffic.
I would like some assurance that if said events should happen
that the road be restored to its present condition.
Otherwise, I have no objection to the application.
Please make this a part of your record.

Dear Mr. Cuddy I
In reply to a telephone request from your office, the
minutes and actions of the Board of Appeals meeting held on
April 29th have not as yet been approved. As soon as they
are approved on May 20, 1976, I will send you a copy of the
action of the Board. However, unofficially, according to
my minutes IT WAS RESOLVED, John Simioich, Ole Jule Lane,
Mattituok, New York, be GRANTED permission to construot dwelling
with lack of approved access on the west side of Camp Mineola
Road, Mattituck, New York, as applied for, subject to the
following conditions I
1. That applioant reserve 12 1/2 feet on the easterly
border of the lot to be created by this action con-
tiguous to the westerly border of the present Camp
Mineola private roadl and that applicant agree to
dedicate this property for a Town road providing the
adjoining neighbor to the south, Jane Booth McGrath,
a180 dedioates 12 1/2 feet I and providing the neighbor
to the east, Marguerite Norris, also dedioates 12 1/2
feet on the easterly side of Camp Mineola Road.
2. A further condition is that you, the applioant, shall
repair and restore to its original condition the present
private road from Kraus Road up through private road on
your own property (it may be necessary to fill the pot-
holes with blacktop), subject to the approval of the
Building Inspector.

I am relying upon your fair judgment and advice
pursuant to the matter of the 12t feet Variance, 280A
Town Law. adjacent to my property.
I assume you have my welfare in mind if and when
you grant this variance. This variance, however, would
not be acceptable to me under any circumstances unless
the road be maintained in its present condition at all
times to give me viable access to my dri"eway and propwty.
If any futuro developements come to light, I will

Accordingly, we will make the decision on April 29th, 1976
at 7:30 P.M.
The applicant's offer to reserve 12 1/2 feet along
the westerly boundary of Camp Mineola Road for future
road dedication seems fair. Hopefully, it will be matched
by others on both sides of the road, in an effort to solve
this road problem.

Dear Mr. Gillispie:
Enclosed is a copy of a letter which we forwarded to the
Southold Town Planning Board after meeting with the Zoning
Board of Appeals on Thursday, April 8th. Also enclosed is
the reply from the secretary to the Planning Board indicating
that the Planning Board will not have a meeting until May
3rd.
Mr. Simicich has indicated, and we reiterate here, that he
will reserve a portion of his property to an extent of 12
1/2 feet along the westerly boundary of Camp Mineola Road
for dedication to the Town for public road purposes. This
reservation will be placed in the deed made to Mr. Simicich's
grantee and will run with the land.
In fairness to Mr. Simicich it would appear that his appli-
cation is a proper one and that with the above stipulation
the application should be granted.
We have no objection to appearing before the Planning Board
for further discussion but under the circumstances, where
Mr. Simicich has agreed to reserve a portion of his property
for future road use, and the Planning Board will not meet for
several weeks, we believe it is appropriate to request that
the Zoning Board of Appeals pass upon his application for a
variance pursuant to Section 280-a of the Town Law.
In order to have the file appropriately documented please
feel free to place this letter and its contents before the
Board so that the stipulation or agreement by Mr. Simicich
is made part of the record.
