1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
square
sary HARDSHIP because the subject property is of an area size of 10, 545/feet
and the strict application of the Ordinance, Code of the Town of Southold,
Zoning, Chapter 100, Article III, Section 100-31, will produce practical
difficulties and unnecessary HARDSHIP to the applicant if an area variance
is not granted to allow said applicant to sell the subject property with
assurances that a one-family dwelling may be erected.
2. The hardship created is UNIQUE and is not shared by 011 properties alike in the immediate
vicinity of this property and in this use district because the subj ect property is
presently unimproved, unlike the alike properties in the immediate
vicinity, and does not presently have a one-family residence constructed
thereon and hence the hardship to the subject property is unique.
Applicant does not own any adjourning property.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the subject property is of a lot size
approximately the same as the alike properties in the immediate vicinity
upon which there are presently located private residences and the
construction of a private one-family residence upon the subject property
would not change the character of the district or violate the spirit
of the ordinance.
