Please see attached map and schedule of lots and sizes indicating that the average lot size is 17,360 square feet, in the block bounded on the north by Pine Neck Road, on the east by North Bayview Road, on the south by Oakwood Drive, and on the west by Oakwood D~iv~. Applicant's cottage and garage are located in the northerly portion of the property. It would be an unnecessary hardship to maintain the southerly portion of the property. 2. I., N.Y. 11944 August 27, 1976 To: The Members of the Board of Appeals Re: Area Variances Dear Sirs: You have requested that I advise you with respect to the law to be applied by the Board of Appeals when it considers an application for an area variance. An area variance is to be distinguished from a use variance and the rules to be applied are different with respect to the two types of variances. In a use variance proof of "unnecessary hardship" must be shown, whereas in an area variance case only "practical difficulties" must be shown (Bronxville v. Francis, 1 AD2d 236). In the case of Hoffman v. Harris, 17 NY2d 138, the Court of Appeals rationalized the distinction between an area variance and a use variance in the following language: "There is a good reason for the distinction between use and area variances and the requirement of a higher standard of proof for the former. When the variance is one of area only, there is no change in the character of the zoned district and the neighborhood consider- ations are not so strong. In such a case, it seems fair thai only practical difficulties without unique or special hardship need be proven to obtain a variance." The courts have not specifically defined the term "practical difficulties", however in the case of Wachsberger v. Michalis, 19 Misc. 2d 901, the court enumerated certain matters to be considered as follows: (1) How substantial the variance is in relation to the requirement; (2) The effect, if the variance is allowed, of the increased population density thus produced on available governmental facilities; (3) Whether a substantial change will be produced in the character of the neighborhood or a substantial detriment to adjoining properties created; (4) Whether the difficulty can be obviated by some method feasible for the applicant to pursue other than a variance; and (5) Whether in view of the manner in which the difficulty arose and in consideration of all the above factors the interest of justice will be served by allowing the variance. Members of tne Board of Appeals -2- August 27, 1976 In 1967 the Court of Appeals decided the case of Fulling v. Palumbo, 21 NY2d 30, which substantially changed the rules to be applied in area variance cases. In the Fulling case, a landowner sought an area variance to permit the sale of a vacant substandard lot...The landowner acquired the vacant lot and an improved lot adjacent to it at a time when both lots were in compliance with the zoning ordinance which required a minimum lot area of 9, 500 square feet. Thereafter the zoning ordinance was amended to increase the lot size to 12, 000 square feet. The zoning amendment thus caused the vacant lot to become substandard. The owner proved that he paid $5,000 for the lot in question and was offered $11, 000 for it by his neighbors and that if the variance was granted that he could sell it for almost $22, 000. It was also shown that every adjacent lot was less than 9,500 square feet in area and that in the "area" in which the lot was located thirty lots were under 9,500 square feet; twenty-four were from 9, 500 square feet to 10,500 square feet in area; nine were over 10, 500 square feet but less than 12, 000 square feet and only twenty were over 12,000 square feet in area and that the few lots over 12, 000 square feet In area were actually an "island" among substandard lots and that by reason of these circumstances it could not be reasonably argued that the character of the immediate area would be adversely affected by granting the variance. The Court of Appeals directed that a variance be granted and stated the new rule to be as follows: "Where the property owner will suffer significant economic injury by the application of an area standard ordinance, that standard can be justified only by a showing that the public health, safety and wel- fare will be served by upholding the application of the standard and denying the variance." By virtue of the language of the Court In the Fulling case, once an applicant for an area variance proves that the area restriction as applied to his land "imposes sig- nificant economic injury", he must be granted the variance unless the Board of Appeals goes forward with proof that the denial of the variance will "serve the public health, safety and welfare". By reason of the broad language used by the Court in the Fulling case, subsequent court decisions have been concerned mainly with what constitutes "significant economic injury" and what the Board of Appeals must prove to show that "the public health, safety and welfare" requires a denial of the variance. On the question of "significant economic injury", it would appear from the cases that if the applicant can show that he will be able to sell the land in question for substantially more money if granted a variance than if the same is denied, he has met the economic injury test. The question of "public health, safety and welfare" appears to turn on the issue of the character of the neighborhood, i.e. the size of adjacent lots and lots in the immediate neighborhood. The cases seem to indicate that the Board of Appeals will usually be sustained by the courts in denying a variance where it has demonstrated that most of the neighboring lots are substantially larger than the lot in question, or that in a case where a variance has been granted, that the neighboring lots are of Members of thc. ]~oar'd of Appeals -3- August 27, 1976 substantially the same or smaller size than the lot in question.
