Please find enclosed a copy of the Planning Board's letter of
1.~arch 4, 1976. ~e originally filed with the ZbA on January 16,
1976. The application was first heard at the February 5th i~eet-
in9. It was sent by them to the Planning Board. The Planning
Doard responded with the Letter of March 4, 1976, after which it
was sent );ack to the ZBA and approved at the April 8, 1976 meet-
ir,.g. The surveyor was then informed and later told me that the
survey had been sent to Mr. Terry.
Mr. Terry checked the property and approved condition of Emergency
Right of ,"ay. Fence was installed the following year after being
approved by Mr. %'erry.

The Southold Town Planning Board reviewed your request
to set off and divide the unused portion o£ your property into
three ~uilding lots. The Board of Appeals in an kmderstsnding
wi%h the Pluming Board cannot divide a piece o£ property into
more than two lots. The Planning Board cannot approve a sub-
division containing lo%s of less than 40,000 square feet.
If you were to subdivide your total area of 1.90 acres,
more or less, into two lots you would still need a variance
from the Board of Appeals £or one lot because it would be
less than 40,000 square feet.

Dear Sir:
My house is located on West Lane in East Marion,
N.Y. I am also writing on behalf of Mr. and Mrs. Thomas
Siculiano of West Lane and Mr. and Mrs. James O'Neill of
East Lane, East Marion, N. Y.
We are of the opinion that the application for the
variance on behalf of Mr. Lang should be denied. The
affected premises consists of 1.9 acres on which there is
presently situated a private residence. The Zoning for the
Township of $outhold requires a minimum of one acre per
residence. Mr. Lange's application is for permission to
construct an additional three houses on these premises
making a total of 4 houses on 1.9 acres where only one house
is permitted.
However, our objection is directed to a matter of
graver consequence and concern, not only to us and other
residents, of ~he Township but I am certain also to your
Board, to wit: the problem of water supply and sewerage
disposal. It is my understanding that one of the reasons
for the restrictive zoning results from the report of a
study conducted by the Environmental Conservation Committee
which among other things indicated the seriousness of a
possible shortage of the underground water supply and its
potability and of the sewerage disposal.

Gentlemen:
I would like to express my opinion with respect to
the petition of Kenneth and Susan Lange~.Fto obtain a
variance on their property in East Marion, and on
which a public hearing has been adjourned to March
18, 1976.
It is my understanding that the subject property has
been zoned for two lots. I assume this was done by
the town for the best interest of the community after
taking into consideration water tables, drainage,
sewage, access roads etc.
I can understand that in blanket zoning of this type
that inequities do arise, and variances are granted
to correct these, e.g. if a person owned 2 7/8 acres
and the area was zoned for 1 acre plots, a variance
for the 7/8 acre would seem equitable and still
within the essence and spirit of the law.
I can also see justification for a variance if the
facts on which the zoming.~Was,>bas~d have changed,
or if the parties responsible for the zoning had
been mistaken or capricious
Apparently the appeal is based'on the fact that other
plots in the area are smaller. To grant a variance on
this basis would make all zoning progress difficult,
and create a dangereus' precedent for all future appeals.
I rely on the wisdom of the Board, in possession of
all the facts, for a proper decision.

Gentlemen:
As taxpayers in the Old Orchard Area of East Marion
we object to the granting of any variance to build
3 houses adjacent to East Lane as opposed to the
restriction limiting to 2 houses at this time.
The effect on sewage disposal, lowering of the water
table, and spacing of homes is totally undesirable
and we wish to go on record as requesting that no
change be made.

Dear Members of the Board:
We have been advised that a Mr. Kenneth Lange of
Connecticut has made an application to the Southold
Zoning Board for a variance relating to his newly
acquired property located in East Marion. We believe
the original zoning requirements should be maintained.
As the owners of the property across the private
road from this former "Edwards" property, we are
very hopeful this application will be denied. We
have owned our home since 1957, and were told when
we purchased our property on East and South Lanes,
Old Orchard, that the vacant land on the other side
of East Lane was owned by the Edwards family and that
they had no rights to our road, nor to our 150' of
beach area. It seems we were misinformed.
However, we respectfully request that no more than
two houses be permitted to be erected by this builder,
on the East side of East Lane, Old Orchard, East Marion.
We appreciate very much your kind consideration, and
regret that we will not be a~le to attend the hearing
on March 18th.

bounded on the north by North Lane - Thorp; on the

IT WAS RESOLVED that this hearing on Appeal No. 2099,
Kenneth and Susan Lange, 1887 Newfield Avenue, Stamford,
Connecticut shall be recessed until 7:30 P.M. (E.S.T.)
March 18, 1976 to allow time for applicant to seek Southold
Town Planning Board and Department of ~vironmental Con-
servation approval.
I am also enclosing a copy of tax map which shows that
most of the surrounding properties are e~aller than the
proposed division would be.

The following action was taken by the Southold Town
Planning Board at a regular meeting held March 15, 1976.
RESOLVED that South Lane be continued at a thirty foot
width to the Building Inspector's specifications on
property of Mr. and Mrs. Kenneth Lange. This will leave
one lot of approximately one-half acre south of the road
and approximately one and a half acres north of the road.
The Planning Board has no objection if this property is
approved by the Board of Appeals to be divided providing

Under the subject file, Applicant Lang is seeking a zoning variance
to permit the construction of three additional dwellings on a 1.9 acre piece
of property al ready containing one dwelling.
The granting of this permit or even a modification thereof would
completely negate the 1970 Environmental Study calling for a minimum of one
house per acre.
The area involved adjoins the Old Orchard Section in which I own a
home. This area has already been subdivided prior to the one acre ruling
which means several additional housing units can be built in addition to
those currently existing.
The construction of three additional houses contemplated by the
Application could have a serious and adverse effect on the underground water
supply of the area as well as possible sewage disposal problems. The private
road system in the Old Orchard area, which presumably under some unknown ar-
rangement would be utilized during construction and after occupancy of the
new units, is in poor condition as the roads are dirt with no permanent cov-
ering. Any additional traffic, especially heavy construction equipment would
further deteriorate these roads to the detriment of the area residents.
It is respectfully urged that Application 2099 be denied as not
being in the public interest and an unnecessary attempt to circumvent exist-
ing zoning laws for the benefit of an individual at the expense of a community.
