The findings of the Board are that the Board is in agreement with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Micheline M. REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 (x ) A Variance to the Zoning Ordinance ( ) is requested for the reason that The premises were acquired by the applicants mother and father in 1929 and 1944 by various deeds of conveyance and are improved with two seperate dwellings that have been always individually and seperately occupied by un- related family units. The applicant inherited the premises from her mother and now wishes to sell the houses seperately and this variance is required to enable the premises to be divided into seperate parcels Form zB1 (Continue on other side) REASON FOR APPEAL © Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the premises are not readily saleable with two houses thereon, and the premises having always been seperately occupied, by being seperated into two seperate parcels will cause no depreciation of surrounding property values or otherwise create any condition of traffic or health nature that would be detrimental to the surrounding properties and/or the occupants thereof; 2, The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because The premises were purchased and used as seperate dwelling units, on the size plot involved, 'since prior to the enactment of the .present Town Zoning Ordinances. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because as above indicated the property itself would be in no way more densely or differently used, than as at the present time, which use has prevailed for over 45 years. } STATE OF 1 11, ss ..... .. . ........... .. .......... Oenue February 21, 1975 Building Dep rtment Town of Southold Southold, N.Y. Re: Premises - Fisher 's Island, N.Y. Gentlemen: Enclosed herewith please find a surley print concerning premises located on Fisher's Island, N.Y, on which you will note there are two dwellings, one on each end of the property, with frontage of some 148.75 feet. I would appreciate it if you could advise me as to what the zoning requirements are with respect to these premises as my client, the owner by will of the premises, is desirous of selling both of these house as individual parcels and I would appreciate it if you would forward to me whatever forms and other requirements are necessary in order to have these premises sold as individual tracts, with a dividing line approximately down the middle of the property some 75 feet of frontage being had for each parcel on Montauk Avenue. To the best of my knowledge and belief, these buildings have been in existence since prior to the zoning ordinances of the Town of Southold and while I realize that the property is now owned as one separate parcel, they were purchased as separate parcels many years ago and I would like to arrange to have it possible for my client to sell these premises . Check is enclosed of this office which you are authorized to co.'nplete in an amount not in excess of w25.00 to cover any fees and charges that, tere ht be for forwarding to me a copy of the zoning ordikialht-ke an pertinent documents with respect to the premises involved and a o any forms or other requirements needed for such a division of land. These are "pre-existing buildings" built bedore our zoning ordinarce and are "non-conforming buildings" today. Enclosed as requested are application forms to Board of Appeals to divide the lot with one building on each lot. Also enclosed are application forms for "pre- C/019" on each building. We usually make an inspection of the older buildings before issuing a C/ Who would have a key or could let us into the houses to make such an inspection? Also enclosed as requested is a current copy of the zoning ordinance and receipt for the 6 4.28 fee from Town clerk. The zoning map can be obtained from Roderick VanTuyl$ SurveyorFront & Main Stq Greenport at 9 5.00 per sheet ( Fishers Isi land s a single sheet) . Our Board meets every three weeks, all applications should be filed in duplicate; F-e to Appelas Board is $ 15.00 and $ 5.00 for each C/0. The zoning of these buildings is "A" residential-agricultural requiring 150 ft width and 40,000 Sq Ft area each. Should you have further questions give us a call. Yours truly Zu ---` ( lding Inspector / o i October 8, 1974 Mr. Alfred Grebe Fishers Island, New York 11964 Dear Fred: Re: Kathleen ,Pacuet Montauk Ave. , Fishers Island I have been in touch with Bob Gillispie with regard to dividing property owned by the above. Our records indicate two houses on three quarters of an acre. However, we do not have dimensions of buildings and location of dwellings on property. It will be necessary for Ms. Paquet to furnish an accurate survey of the property giving dimensions of buildings with front, side, and rear yard distances from buildings. Also, the survey should indicate the proposed division of property with the side yard distances between each dwelling. It would be advisable to indicate present location of cesspools on peemises. Enclosed herewith are forms of application for a variance. Yours truly, EH:mm Edward Hindermann Building Inspector cc: R. W.
