2. VARIANCE. By resolution of the Board it was determined that

After investigation and inspection the Board finds that
applicant requests permission to construct swimming pool in '
front yard area of property located Rocky Point Road/Circle Drive,
East Marion, New York. The findings of the Board are that this
is the most feasible location for the pool. The Board agrees
with the reasoning of the applicant.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property
and in the same use district; and the variance will not change
the character of the neighborhood, and will observe the spirit
of the Ordinance.
THEREFORE IT WAS RESOLVED, Donald King, East Marion, New
York, be GRANTED permission to construct swimming pool in front
yard area of property located at Rocky Point Road/Circle Drive,
East Marion, New York, as applied for, subject to the following
conditions:
1. That the pool structure shall be no closer to Circle
Drive (as designated on the map) than 20 feet.
2. That the pool structure shall be no closer than 50 feet
to the easterly side line of the Stamos property.

Doyen.

Dear Mrs. Mardikos=
In accordance with our.telephone, conversation on March
3rd, 1976, I have now received the application of Donald
King, Rocky Point Road, East Marion, N. Y. This property
was formerly in the name of Savas.
The application did not arrive in time to be included
in the agenda of our March 18 meeting. The next meeting
will be April 8, 1976 and the legal notice, giving the time
and place of hearing, will appear in the official newspapers
of the Town - the Suffolk Weekly Times and the Long Island
Traveler-Mattituck Watchman - on Thursday, April 1, 1976. The
Board of Appeals will not set the time for this hearing until
March 18th.
The applicant states in his application that this is
a through plot from Rocky Point Road to Circle Drive - most
other properties front only on one street. He also states
that the entry to the dwelling is from Rocky Point Road while
the area south of Circle Drive is used as s backyard area,
and is the logical and most convenient location for the
proposed pool.
A Local Law was enacted on May 27, 1975 requiring applicants
to notify adjoining neighbors by certified mail that they
were applying for variances. Previous tO that date, the only
notification was by legal notice in the official newspapers
of the Town.
