REASON FOR APPEAL
A Variance to Section 280A Subsection 3
A Variance to the Zoning Ordinance
is requested forthe reasonthat applicant wishes to sell the property as a single
lot. Applicant acquired this lot from Kathryn Fleet bY deed dated 10/22/65.
In 19~ under the Last Will and Test~ent of her mother, Cora Manning,
applicant acquired the lot south of the present one. Inadvertently, and
without permission of the Board of Appeals, applicant sold the adjacent one
to Edward C. Wylie in 1967.
(Continue on other side)
REASON FOR APPEAL
Continued
1. STRICT APPLI~ZATION OF THE ORDINANCE wouid produce practical '"~ .....
sary HARDSHIP because the lot would be unusable since no building, permit
could be obtained~
2. The nardsh'p created is UNIQUE and is not snarea' by ah .~?.h.sx':~ alxe'~ in the immediate
vicinity of this property and in this use district because the lots in this vicinity are
practically the same sized except the property of Todebush to the
North.
3. The Variance would observe the spirit of the Ordinance and WvuLu Nu CHANGE THE
CHARACTER OF THE DISTRICT because this has always been considered a single
lot.
