I,
After investigation and inspection the Board finds
that applicant requests permission to construct rear porch
which will leave insufficient rear yard on the west side
of Gillette Drive, East Marion, New York. The findings
of the Board are that applicant possesses an undersized
lot which was created prior to the establishment of an
Ordinance. The Board agrees with the reasoning of the
applicant.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property
and in the same use district; and the variance will not
change the character of the neighborhood, and will observe
the spirit of the Ordinance.
THEREFORE IT WAS RESOLVED, Duncan K. & Charlotte B.
Haldane, (George Ahlers, Builder, 250 Cox Lane, Cutchogue,
New York) , be GRANTED permission to construct rear porch
which will leave insufficient rear yard on the west side
of Gillette Drive, East Marion, New York, as applied for,
subject to the following condition:
That the porch shall be enclosed with screens and
shall not now or ever be made into a permanent
enclosure, or habitable space.
Vote of the Board: Ayes:- Messrs: Gillispie, Bergen,
Grigonis, Hulse, Doyen.

REASON FOR APPEAL Continued
3. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because The house as designed has a screened patio in. the
a' - it
rear. Due to the shallow lot, 1.S not p3SSi'" ' e to comply _ have =' V
enclosed an wi1h the ordiabce. This home was designed as a
te
retirement home and the porch is imv r':.antC. to Mr & Mrs. _aldsne.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because The other homes in the neighbor-
hood do not have the projecting garage in the front which must comply
with the 30' yard set back. With the proch in the rear, the house
is too deep.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because The posch is open, enclosed only with
screens. There are no provisions for future permanent enclosure.
Being only a porch on a home, it is not in conflict with the charac-
ter of the surrounding district.
