REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 (X) A Variance to the Zoning Ordinance ( ) is requested for the reason that applicant wishes to divide property ot 2.693 acres into a minor subdivision of three lots, wn1cn plan has been approved by the Planning Board subject to the approval of this Board. Such approval 1s necessary because one of the three lots will be 37,305 sq. ft. instead ot 40,000 sq. ft. Form ZBl (Continue an ather side) REASON FOR APPEAL o Continued o 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because unlen applicant i8 permitted to divide into three lots he will suffer significant economic injury. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because applicants property is wooded and although there are 8 rew smaller parcels in the area applicants property is basIcally surrounded by larger cle~red parcels apparently devoted to farmIng. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the three lots taken as a whole have suf- ficient area to cover over 97.75% of that required by the ordinance and the under.lEed lot will be over 93% of that required for a single lot, and the public health. safety and welfare will not thereby be affected.
