1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because
Mrs. Dooley's father must move in with them and the only
available space is to convert the existing garage into
a bedroom and living room due to the fact that theMrlocation D 1

of the property is in Orient-by-the-Sea and open, ~
must have a garage in which to keep their car. The only
spot to place the garage on the lot, is in the front yard of
the house. If they are not allowed to build the garage in
the front yard, it would produce a hardship in that it would
expose their car to the elements and creating difficulty in
starting the car due to the extreme weather conditions which

2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because
the other homes are not spread out across the lot as this
home is, taking up almost all the available side yard space.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
a)the garage would be designed to be in keeping with the
existing house
b)all the other homes on either side of this are built
closer to the road than this house and we would not
be changing the existing setback lines on the adjacent
houses to any great extent
c)the new setback would still be 35' which is the town
minimum setback
