Ales 329 Forest Road Douglaston, New York 11363 Re: Application of Rosemarie Burnside for a variance to construct a fence higher than permitted by the Zoning Code on Plot #70, adjoining our plot #71, Nassau Point. Mrs. Burnside's application for a variance in order to increase the height of the fence on our mutual property line from six feet to twelve feet states some things which I would like to correct for the recordr in case I am unable to speak at the hearing December 2nd, 976. My father bought the property, Lot #71, in 1924, and over the years it has remained wooded. When the Burnsides bought the property several years ago, it was indeed very private. Two years ago, when the land near the bluff was cleared for a hoUse and garage, it was necessary to cut off the top of a hill and level the ground for construction. See attached Exhibit A. The Board of Appeals in granting a variahce to build a garage in the front yard rather than the rear, or water~ side of the property~ required us to place our garage fifteen feet from the lines, and consequently the driveway goes on the low side of the plot and that stde-is somewhat raised in order to make a level drive, and to prevent run-off going into the neighboring land. At no time, however. was the land elevated where the house is situated, which is sixty~four feet away from the northerly property line. It is true that our windows look at each other, but at a dis- tance of 83 feet, an en'liable condition, when many houses are only 20 to 25 feet from each other. The Burnside residence, which is set at an angle, results in two sides of that house, instead of one, being seen from our home. Also to be seen from our house is an unattractive tele- vision tower of more than thirty fee~and a three car garage, both sitting as close to the property line as the code allowed. In fact, the tower would not now be allowed under the present building code. Nor is the planting of Japanese pine a foot from the line allowed by the code. For all these reasons, we agree with Mrs. Burnside that a fence might render greater privacy to both properties, and we will agree to it, if it is built fully on the north side of the line, which the present fence is not, and particularly-if something can be done about the television tower.
