Y. at a meeting of the Zoning Board of Appeals on May 20, 1976 the appeal was considered and the action indicated below was taken on your ( ) Request for variance due to lack of access to property ( Request for a special exception under the Zoning Ordinance ( ) Request for a variance to the Zoning Ordinance 1. SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception ( ) be granted ( ) be denied pursuant to Article .................... Section .................... (E.D.S.T. ) upon application of Edward C. Clingen, Young's Road, Orient, New York for a special exception in accordance with the Zoning Ordinance, Article III, Section 100-30 C (6F) for permission to erect off-premises rental sign. Location of property: South side Main Road, Orient, New York, bounded on the north by Main Road (Rte 25) ; east by C. Knispel; south by Hale & Kellogg; west by Floyd King. Fee paid $15.00. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. This is a type of use which has long ago been dis- continued in the Town of Southold, c.- `_ted se, It is not a permitted use; it is solely for the benefit of the owner and is not in the general interest of the people of the Town of Southold. The Board does not agree with the reasoning of the applicant. The Board finds that the public convenience and welfare and justice will not be served and the legally established or permitted use of neighborhood property and adjoining use districts will be permanently or substantially injured and the spirit of the Ordinance will not be observed. THEREFORE IT WAS RESOLVED, Edward C. Clingen, Young's Road, Orient, New York be DENIED permission to erect off-premises rental sign for the reasons stated.
