King; west by now or formerly N. Addy. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. After investigation and inspection the Board finds that the applicant requests permission to divide premises into two lots with insufficient width and area, south side New Suffolk Avenue and west side Ole Jule Lane, Mattituck, New York. The findings of the Board are that 12 out of 14 of the surrounding lots are undersized, and the division would be in keeping with the character of the area. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is qnique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Catherine A. Colon, New Suffolk Avenue, Mattituck, New York be GRANTED permission to divide premises into two lots with insufficient width and area, south side New Suffolk Avenue and west side Ole Jule Lane, Mattituck, New York, as applied for. King and Christine King who not only owned the premises but a residence and acreage to the south along 01e Jule Lane. Applicant was unable at that time to ~ake the premises in separate ownership since her husband was an invalid and her daughter was under age. X 2. The hardship createdis UNIQUEand isnotshared by all properties alike in the immediate vicinity of this property and in this use district because this is the only parcel on the south side of New Suffolk Avenue which has additional frontage not occupied by a dwelling. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT becausethe properties on the south side of New Suffolk Avenue westwar8 have frontages which are nonconforming and narrow. The areas also are smell. The residence on this parcel would, therefore, conform to the area in general. It is also to be noted that applicant~s idence is 23 feet from the easterly line of her original holding and there would be ample distance between the ~o houses.
