FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION: Applicants' property is a parcel of 16,020 sq. ft. in
Southold, with 90 ft. of frontage on Oak Drive and a depth of 178 feet. It is improved with
a one-story frame house, which was recently demolished. A building permit (#28685-Z)
was issued for additions and alterations to the existing dwelling, after issuance of the
January 24, 2002 variance under ZBA Appeal No. 5049 (see building permit file for
detailed information).
BASIS OF APPLICATION: The basis of this application is the Building Department's
November 26, 2002 Notice of Disapproval concerning construction of a new dwelling,
replacing the single-family dwelling which existed recently prior to its demolition. The
reason for the disapproval is that the setback of the new construction is less than the
code requirement of 35 feet from the front property line, as per Section 100-244B.
AREA VARIANCE RELIEF REQUESTED: Applicant requests a variance to locate an
addition as proposed at 18 feet from the front property line.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted, and personal inspection,the Board makes the following findings:
1. Applicant wishes to reconstruct a new foundation, instead of the previous relief
requested under Appl. No. 5049 for the expanding or adding a second floor and a
small front porch. The front setback with the porch was previously permitted to
be reduced to 18 feet from the front line. The Code requires a 35-foot setback, so
applicant needs a variance for this new construction.
2. The proposed setback is consistent with the relief granted under Appl. No. 5049
and with others in the neighborhood. Also,the front property line on applicant's
and neighboring properties is about 16 feet from the edge of the pavement of Oak
Drive (a private street unlikely to be widened), so that the setback of applicant's
proposed porch from the pavement is about 34 feet. For these reasons, grant of
the requested variance will not produce an undesirable change in the character of
the neighborhood or detriment to nearby properties.
3. There is no evidence that grant of the area variance will have an adverse effect or
impact on physical or environmental conditions in the neighborhood.

4. Grant of the area variance is the minimum action necessary and adequate to
enable applicant to enjoy the benefit of an expanded home while preserving and
protecting the character of the neighborhood, and the health, safety and welfare
of the community.
RESOLUTION/ACTION: NOW, THEREFORE, on motion by Member Orlando, seconded
by Chairman Goehringer, it was
RESOLVED, to GRANT a variance authorizing a front yard setsback of 18 feet, as
set forth in the applicant's Building Permit application and plans amended
October 2002, prepared by Charles M. Thomas, Architect.
This action does not authorize or condone any current or future use, setback or other feature
of the subject property that may violate the Zoning Code, other than such uses, setbacks and
other features as are expressly addressed in this action.

100 (Zoning), Code of the Town of Southold, the following hearing will be held by the
SOUTHOLD TOWN BOARD OF APPEALS at the Town Hall, 53095 Main Road, Southold,
New York 11971, on Thursday, December 12, 2002, at the time noted below (or as soon
thereafter as possible):
8:00 p.m. Apph No. 5278 -RICHARD AND ANN VANDENBURGH. This is a
request for a Variance under Section 100-244 and 100-242A, based on the
Building Inspector's November 26, 2002 Notice of Disapproval, for new
construction as amended, (after demolition) of the existing dwelling, at less than
35 feet from the front property line, at 1405 Oak Drive, Southold, NY Parcel
1000-80-1-42.
The Board of Appeals will hear all persons, or their representatives, desiring to be heard
at each hearing, and/or desiring to submit written statements before the conclusion of

Amended Application
Dear Chairman Goehringer and Members of the Board:
I find myself with the difficult task of having to write to you again regarding our effort to
complete our home located on Oak Drive in Reydon Shores. You may recall that I originally
appeared before the Board on January 10, 2002 with respect to our application requesting relief
from a set back for purposes of constructing of a porch on the front of our home. That
application was as a result of our initial application to the Building Department for a permit to
alter and add onto our existing property (Permit #28685Z). I have attached a copy of the
Board's decision herein.
EFFORTS TO FOLLOW OUR INITIAL PLANS
While it was our initial intention to add on to our home, which would have included a new
second story addition and front porch, we subsequently learned that the existing structure
would not support our intended alteration. Specifically, following the Board's approval of our
application in January of 2002 arid the issuance of a building permit shortly thereafter, we
began to pursue our initial plans for alteration. Unfortunately after beginning the work we
discovered through our builder that the existing pre-code construction, insufficient structural
elements and pre-existing damage made it all but impossible to salvage any of the existing
elements.
HISTORY OF THE HOUSE
The house was originally constructed in or about the late 1920's and the first part of the
house was built for the purpose of serving as the rental office for the surrounding seasonal
beach house units known as Reydon Shores. Thereafter, subsequent owners began adding on
to the main structure by enclosing an old screen porch and adding two bedrooms and a kitchen.
All of this was done between the 1920's and late 1940's. As a result, the framing and
construction of the walls and floors were well below current standards. -

STRUCTURAL PROBLEMS
It became increasingly apparent that the original construction of the premises did not
offer a safe or suitable basis for adding a second floor or incorporating the addition off the back.
We also discovered extensive pre-existing termite damage in the walls on the South and
Westerly side of the structure and in the floor joist under the bedrooms and living room.
Perhaps this was due to the fact that these areas had crawl spaces with dirt floors that were
barely 12 inches away from the underside of the floor joists.
As we attempted to move forward with our project, our builder discovered that the
existing foundation consisted of only three to four rows of cinderblock that were barely sufficient
to support the existing structure. Moreover, there was no appropriate footing in place beneath
the block and the depth of the blocks below grade was only found to be approximately 12 to 18
inches.
We explored the option of elevating the house in order to correct the inadequate
foundation walls. However, we were told by our builder and architect that due to the haphazard
construction of the various sections of the house, it would not withstand the "jacking" efforts and
would in all likelihood collapse in pieces.
As a result of all of this disturbing news, and the realization that our efforts to
incorporate an addition would be virtually impossible if not prohibitively costly, we realized that
rebuilding the structure according to current building codes, from the ground up, was going to
be our best option.
OUR EFFORTS TO REVISE OUR PLANS
Thus, we returned to our architect and requested that he revise the plans to provide for
the new construction. We wanted to keep the initial foot print the same as we believed that
would best serve the nature and character of the home's incorporation into the surrounding
neighborhood. We did revise the front elevation and sought to add a full front porch as we
believed that design would more closely follow the "craftsman style" that we were interested in.
The foundation plan detailed the new foundation and revised structural elements.
I then submitted an amended permit application to the Building Department that
indicated the construction was' to be "New Building" which included "Demolition" of the
existing structure. I also increased the cost of the project by $75,000 to cover the new
foundation and rebuilding of the first floor. However and unfortunately, the Building Department
apparently misinterpreted the purpose of my amended application. Someone in the Building
Department crossed out my request for New Building & Demolition and wrote in "Porch Add".
Apparently they believed the amendment was for a mere porch addition to our original alteration
addition permit. I had the Building Department make a photocopy of my amended permit
application that reveals this change of which I was unaware. I have attached a copy of the
permit application that I filed and a copy of the permit application changed by the building
department.
I am certain that no one intentionally made such a change with any malice in mind.
Furthermore, I have now been told by the building department that the confusion which
occurred regarding what we intended to do, developed in part on the fact that the revised plans

submitted in connection with my amended application still contained certain references to
"existing" components of the prior home and had no first floor framing detail. I also consistently
find myself erroneously referring to this project as a renovation of our home. While that may be
true in spirit only, I am now trying to be diligent about the terminology involved in order to avoid
further confusion. In any event, all of this may have led the Building Department to believe it
was still an alteration project.
However, as I was unaware of the change made by the Building Department to
my amended application, I still believed that I was pursuing a New Building Permit.
Thus, when I was instructed to return to the Zoning Board of Appeals for purposes of
obtaining the clarification on the full porch variance. I believed all was in order.
This Board was gracious enough to provide me and the Building Department with the
clarification on the full porch issue and I was ecstatic to learn that the Building Department had
approved my amended application. Our dream of a new home appeared one step closer to
reality. Immediately thereafter, the rest of our home was demolished and a new foundation was
installed in exactly the same location as the prior structure along with the permitted front porch
addition.
THE QUESTION OF PERMISSION IS CLARIFIED
Immediately following the installation of the new foundation, we contacted the Town in
order to conduct the necessary foundation inspection. The inspector passed the foundation but
pointed out that the Town showed alteration not addition. At this point the Building Department
was upset to learn that I had removed the entire house and put a new foundation under the
addition alteration permit. The Town instructed me to immediately "Stop Work" -which we have
done.
The Building Department was of the opinion that I had never represented to them that
we intended to pursue new construction and that new construction required additional relief
from the Zoning Board of Appeals. Despite my understanding that I had completed the
amended application seeking what I believed to be the new construction permit, the Building
Department advised me that I had no such approval. I now understand that the required set
backs of the previous structure were considered "pre-existing nonconforming set backs". The
old foundation was located 24.75' from my font yard property line (The new foundation is
now 25' from my front yard property line). .However, and as the Board noted in its
January 2002 decision, the roadway in our neighborhood is an additional 18' feet away
from the font of my property line. In practical terms the old (and new) foundation is
approximately 43' feet from the edge of the road. Additionally, the side of the old
foundation was approximately 12.75' feet from my southerly or side yard lot line (The
new foundation is now 13.17' from the south yard property line). I have attached herein
copies of the survey showing the old structure and the new survey showing the foundation.
Needless to say I am extremely embarrassed at the prospect of having violated any
provision of the Town Code with regard to this matter. I understand what the Building
Department's position is notwithstanding the fact that the plans for constructing our new home
are the same as those contained in our addition / alteration permit (with the exception of the
roof line and front porch enlargement).

Moreover, notwithstanding the fact that we removed the old and inadequate block
foundation and installed the new poured foundation in exactly the same spot, I understand that
we are not necessarily entitled, without this Board's approval, to be in the same location on the
property. The Building Department has pointed out that regardless of the fact that I am
attempting to rebuild the home in the exact location where it stood before, the new foundation
raises the issue of the Zoning Codes set back requirements for new construction in this zone.
THE NEEDED RELIEF
I understand that the applicable zone is R-40. While I am not certain, I believe that a
new construction front yard set backs is as much as 50 feet but may be 35 feet for my lot size.
Furthermore, I believe a new construction side yard set back is 15 feet. I am not certain if my
lot size entitles me to a smaller set back requirement. As I've stated previously, the new
foundation is 25 feet back from the front yard lot line. Additionally, the side yard set back
should be 15 feet from the southerly lot line and the new foundation is now as close as 13.17'
feet from the lot line. Again, the new structure is basically in the exact same location as the old
structure. Apparently, this does create an issue with regard to the need for relief from the set
back requirements.
As I have stated, it is our objective to rebuild our home in a manner and style that is
consistent with the surrounding neighborhood. As I mentioned in my prior correspondence, we
redrew the front elevation so that it would be more in keeping with the surrounding parcels and
hope to complete the home with a theme of the late 1920's "Craftsman Style" construction
which is mirrored after some of the other older homes qualities in our neighborhood. I have
attached elevations of the new structure herein - which the Board will note is the same as what
we had intended to do under our alteration.
We sought to keep the location of our home in the same position that it was before, as
that is also typically consistent with the other homes on our side of our street. Additionally, we
hoped to preserve the other significant aspect of the value to our property which is a waterview
from the northeasterly corner of the house when situated in the original location.
Finally, we have continued to keep all of our contiguous neighbors updated with regard
to the progress and development of our home, as they are not only our neighbors but are also
our friends. With the development of this recent issue and misunderstanding, I have explained
to them that their views and concerns are most certainly relevant to my request for relief from
the Board.
My wife and I are year-round local residents who have no expectation of ever leaving
Southold Town. We are looking forward to raising our two young boys from our home in
Reydon Shores as we could not think of a nicer place to do so. Prior to deciding to undertake
this project, we had searched for several years for a larger home to purchase in Southold Town
in order to avoid the substantial upheaval and cost of rebuilding. Despite our efforts, we kept
returning to our neighborhood as the best environment for our children and our family. We
have the highest respect for our neighbors and as an officer and member of the board of
directors in our community association, the health, safety and well being of our neighborhood is
equally important.
Thus, I am humbled and honored at my neighbors' willingness to support our efforts
toward rebuilding. I am enclosing letters from each neighbor that indicates that they are well

aware of our predicament and do not have any reservation or negative comment with respect to
the relief that we are requesting. I enclose those letters herein for the Boards review.
OUR OBJECTIVE AT THIS POINT
I certainly understand the need in certain instances to afford the general public an
opportunity to be heard with regard to relief that is typically sought from the Zoning Code.
However, in the present case, I am hoping that the Board could determine that the conditions
present are some-what unique and based upon the information presented herein, the relief we
are requesting could be approved without the need for a new formal application and public
hearing.
Our greatest concern is that the dates for public hearing and comment under new
applications are anywhere from four to six months away. That prospect with the current state of
our rebuilding would create an extreme hardship upon my family. We unfortunately only have
living arrangements until May of 2003. If we are unable to perform any additional work until this
issue is resolved by new application and public hearing before the Board, we will not be able to
complete the rebuilding within the period of our current housing arrangements. Had my
amended application been originally denied because of the new construction set-back issues,
we would have refrained from demolishing the entire home until after the Board's review. We
could have then begun the rebuilding process without the pressure of having to locate alternate
housing beyond our current arrangements. I realize this is now classically a hindsight
observation but quite simply put, now I am in a "serious pickle" and we need the Board's help.
Based upon the support of our surrounding neighbors and their specific written consent
to the relief that we are seeking, I respectfully urge the Board to find that the public safety and
welfare of the surrounding community would be secured and not be adversely affected by our
rebuilding the home in the same location as it was before. Moreover, in reaching such a
determination, I sincerely believe the Board would insure that substantial justice would be
achieved in considering the request for relief in light of the surrounding factors and extreme
hardship that has developed.
Again, I am sincerely grateful for the Board's time in even reviewing this explanation of
the need for relief, and sincerely appreciate any assistance that you can provide in helping me
resolve this situation.

REASONS FOR BOARD AQTION: On the basis of testimony presented, materials
submitted,and personal inspection,the Board makes the following findings:
1. Applicant wishes to expand by adding a second floor and a small front porch.
The front setback is now 24.9 feet; the porch will reduced this to 18 feet. The
Code requires a 36-toot setback, so applicant needs a variance for any sort of
addition to the front of his house.
2. The proposed setback is reasonably consistent with others in the neighborhood.
Aisv, the front property line on applicant's and neighboring properties is about
16 feet from the edge of the pavement of Oak Drive (a private street unlikely to be
widened), so that the setback of applicant's proposed porch from the pavement
is about 34 feet. The proposed structure, as drawn in a submission received
from applicant on January 14, 2002, is consistept with neighborhood homes. For
these reasons, grant of the requested variance will not produce an undesirable
change in the character of the neighborhood or detriment to nearby properties.
3. There is no evidence that grant of the area variance will have an adverse effect or
impact on physical or environmental conditions in the neighborhood.
4. Grant of the area variance is the minimum action necessary and adequate to
enable applicant to enjoy the benefit of an expanded home while preserving and
protecting the cnaracter of the neighborhood, and the health, safety and welfare
of the community.

Please be advised that we are the neighbors to the West of Richard & Ann
Vandenburgh or otherwise located to the rear of their property. Our home is in
Paradise Shores and our backyards meet at the rear of both our parcel and that of
Rich & Ann. We have been neighbors to Rich and Ann since building our home in
1999. While we haven't had the opportunity to become close friends, Rich and Ann
have been good neighbors and we always wave to one another when working in our
yards. Rich and Ann have two young boys and we often see them playing in their
back yard.
Rich & Ann told us about their objective to enlarge their small home to
accommodate their growing family. While we understood from their initial
application that they hoped to add on to their existing home, we now understand
that would not be possible with the condition of the original structure. Thus, they
have changed their plan which has resulted in knocking down the existing structure
and are attempting to rebuild their home as new construction. Rich and Ann have
explained to us their change in plans and we have had the opportunity to study and
review the revised survey, building plans and elevations of their proposed new
home.
