No. 5150—Theodore and Angela Laoudis Property Location: 635 Kimberly Lane,Southold 1000-70-13-20.4 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY DESCRIPTION: The applicant's property_is located on the easterly side of Kimberly Lane in Southold, and consists of a total land area of 87,938 sq. ft. and width of 227.34 feet. The property is improved with a single-family dwelling. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 22, 2002, September 5, 2002, October 3, 2002, and November 14, 2002, at which times written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: BASIS OF APPLICATION: Building Department's April 22, 2002, amended April 30, 2002, Notice of Disapproval denying a permit for a stone wall, entry gate, pillars and sculpture with varying heights that exceed the four-foot height limit set forth in Article XXIII, Section 100- 231. AREA VARIANCE RELIEF REQUESTED: Applicant requests a variance authorizing a stone wall, entry gate, pillars and sculpture with varying heights from 5'6" at the lowest point, to 16'+- at the highest point. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Applicants wish to replace an existing wood fence and gate with a larger and more decorative entry gate, pillars stone wall, and sculptures near the front property line of the residence on Kimberly Lane. Applicants request the additional height of the entry gate to accommodate design features that are unique to the architectural style of the residence. The added wall height, applicant's attorney testified, would provide privacy for the residence and would also create a buffer between the residence and neighbors and vehicles that stop to view the residence. Several neighbors, who live near the property opposed the entry gate because they maintained that it would be highly visible from their houses, and become a viewing attraction that would increase traffic and present safety problems. 3. On November 14, 2002, an amended detailed elevation drawing of the project was submitted to scale down the proposal. A description of the amended plan was articulated in a November 19,2002 letter by applicant's attorney. 4. The board finds that the requested height variances in the amended plan are still quite substantial,60% above the maximum permissible(total height of pillars with sculptures). 5. The board is unaware of any other entry gates and pillars with sculptures, or any other gate-type structures, in the neighborhood that are 10 feet high. Therefore, the proposed project would not be in character with the neighborhood, and could have a negative physical impact on nearby properties by attracting increased traffic. 6. The action set forth below will enable the applicant to construct a wall and entry gates that will afford privacy for the residence. The board concludes that this action will not produce an undesirable change in the character of the neighborhood or be a detriment to nearby properties. 7. The action set forth below is the minimum necessary to enable the applicant to construct a wall and entry gate on the subject lot while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. BOARD RESOLUTION: NOW, THEREFORE, on motion by Member Tortora,seconded by, Member Oliva, it was RESOLVED, to DENY the variance applied for, and alternately to GRANT a variance authorizing the following height limitations for the plans submitted November 14, 2002 (plans entitled, "Gate Elevation"): 1. Wall height up to 5 feet 6 inches,not to exceed 25 feet in length. 2. Gate height up to 8 feet-+. 3. Pillar height up to 7 feet, both sides of gate. 4. We have reviewed the photograph of the proposed structures and remain strongly opposed to them; we do not believe that in any way are they a simple replacement of the original structure. Placing these structures at the front of the Laoudis property places them directly in front of our home, drawing traffic into the neighbourhood to gawk at the spectacle. This traffic will endanger our children and the children on either side of us. We enjoyed our peaceful and quiet street prior to the construction and look forward to regaining that once the construction is completed. Please deny this application so that the privacy of those of us who live on Kimberly Lane and the safety of our children are not compromised. Therefore, since both we and the Harrisons will be out of town Thursday, and have not been contacted with more information, we respectfully request the matter be tabled until the October meeting. As we stated at the August hearing, we and the Harrisons,as are other neighbors who only recently have learned of the variance request, are opposed to Mr. Laoudis' request for a fence/wall above the 4-foot Code,and particularly,the 12'11"-high"deer" monuments. The wall and statues,we believe, will not only be highly visible to us from our houses, but will cause increased traffic and attention to our once peaceful block, and cause a continued safety issue for our young children. The increase in traffic to our block is already excessive,and unfortunately will continue after the cabin is completed, given , the nature and size of construction. Please do not exacerbate our neighborhood problem by approving these highly visible statues, which will no doubt become a local viewing attraction. I did take the initiative to call Ms. Moore on Tuesday after talking to Paula. Ms. Moore informed me that she had just received photos of the clay"deer"prototypes. We and the Harrisons would be happy to view the photos prior to the October Variance Meeting, but most likely, will remain opposed to the variance request. PATRICIA MOORE, ESQ • Yes, that's okay I had actually, I got the photograph late afternoon on Wednesday and I was actually looking for Mr. Mendelbaum's phone number, and fortunately, he called me and said he was out packing the car so I wouldn't even been able to reach him had I tried calling him. When he and I spoke, he told me, his kids were in the car, they were ready to pack up and head west, so it was really inconvenient for him to be detoured to look at these right now and Mrs Harrison had already left I didn't try to reach Mrs Harrison because Mr. Mendelbaum had already told me that she had left the day before. So, unfortunately, I may have their Southold numbers. Her letter didn't include her phone number, her city phone number; I have only a fax came in the transcription.
