1. SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception ( ) be

Doris Helf, 1965 Bray Avenue, Mattituck, New York for a variance in
accordance with the Zoning Ordinance, Article III, Section 100-30
and Bulk Schedule for permission to set off lot with insufficient
width and area and construct dwelling. Location of property: East
side Bray Avenue, Laurel, New York, bounded on the north by G.
Tapfar; east by D. Harkoff; south by E. Klett; west by Bay Avenue.
2. VARIANCE. By resolution of the Board it was determined that

SEE REVERSE
and therefore, it was further determined that the requested variance (
that the previous decisions of the Building Inspector ( ) be confirmed (
) be granted (
) be reversed.
BOARD OF Ai~PEALS
) be denied and
After investigation and inspection, the Board finds that the
applicant requests permission to set off lot with insufficient
width and area and construct dwelling, east side Bray Avenue,
Mattituck, New York. The findings of the Board are that the
Board is in agreement with the reasoning of the applicant.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will not change the
character of the neighborhood, and will observe the spirit of
the Ordinance.
THEREFORE IT WAS RESOLVED, Doris Helf, 1965 Bray Avenue,
Mattituck, New York, be GRANTED permission to set off lot with
insufficient width and area and construct dwelling, east side
Bray Avenue, Mattituck, New York, subject to the following
condition:
This action of the Board is ineffective in the event
that the Town of Southold buys the property in question.
It is the Board's understanding that a contract was
signed on November 30, 1977, between the Town and
Doris Helf to achieve purchase of the parcel referred
to in this application.
Vote of the Board: Ayes: - Messrs: Gillispie, Bergen, Hulse,
Grigonis, Doyen.

Re: Doris Helf; Appeal No. 2348.
Dear Sir:
The Board originally held a hearing on this appeal on
October 13, 1977. The hearing was recessed due to a
letter we received from the Superintendent of Highways
stating that the Town wished to acquire this property
as a drainage s%lmp.
At our meeting held on Thursday of this week the Board
again recessed the hearing until December 1st, at which
time we are required by law to make a decision. (The
law states that the Board must reach a decision within

Gentlemen:
Re: Bray Avenue
Mattituck, New York
I recon~end that a variance be denied for a building lot
on Bray Avenue in order that this property may be used for a
town drainage area. It is imperative that the Town acquire
this piece of property because of the tremendous water problem.
I am making a recon~medation to the Southold Town Board
that this property be acquired for the drainage purpose.
Very t.ruly yours,
RAYMOND C. DEAN
