After investigation and inspection the Board finds that the
applicant requests permission to construct dwelling with insuffi-
cient side-yard setback, Haywaters Road Ext. (Fisherman's Beach
Road), Cutchogue, New York. The findings of the Board are that
the lots in that area are small and many houses have insufficient
side yards.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will not change the
character of the neighborhood, and will observe the spirit of
the Ordinance.
THEREFORE IT WAS RESOLVED, Joseph Gold, Prospect Street,
Freeport, New York, be GRANTED permission to construct dwelling
with insufficient side-yard setback, Haywaters Road Ext. (Fisher-
man's Beach Road), Nassau Point, Cutchogue, New York, as applied
for, subject to the following condition:
The dwelling shall be no closer than 8'6" to the westerly
property line and no closer than 7'6" to the easterly
property line.

Based on the information submitted, that this application not
be approved until the owner of the property upon which the well pit is
located is determined and legal permission obtained from the o~.mer.
Since the determination of the Board of Review submitted to the
Commissioner's office on July 28, 1976, has not been reversed or
modified by her, it is therefore deemed to be the determination of the
Commissioner.
