PRE~/IOUS APPEAL A previous appec ~'~ (has not) been moae with respect to this decisior ( ( D ( ) REASON FOR APPEAL A Variance to Section 280A Subsection 3 A Variance [o the Zoning Ordinance ,s requested forthe reason that~etitio~er has the opportunity to sell a 40,000 square foot parcel of land to a third party as a building plot (See Exhibits 1 and 2 which are attached hereto). However, due to the lot configuration it would be difficult to obtain 150 foot lot width. (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLiCATiON OF THE ORDINANCE would produce praetica]dJffJcultiesorunneces- sory HARDSHIPbecau~ since 1973 the present Zoning Ordinance requires that lot width be 150 feet. To kave a 40~000 square foot lot witk a width of 150 feet conforming with the property lines of the adjoining parcels and the existing woodland would require an area of 60~517 square feet~ This is due to the angle of Cox~s Lane with Petitioner's property~ The best layout of the lot would be in an east/west ~irection~ running from Cox"s Lane to the edge of the woodland~ whick comprises a distance of 402°84 feet resulting in a lot width of 1©6~67 feet along the easterly side of Cox~s Lane (See Exhibit ~}~ ~o require the petitioner to make this lot~ which is ample in size~ to 150 foot in width would be an unnecessary hardship and a waste of tand~ ~he only practical use cf this land is residential because it is unsuited for far~ng and in fact has not been cultivated for over ten years~ 2. The hardship created is UNiQUEandisnotshared by ali properfies alike in fha immediate vicinity of this properfy and in this use district because residences in the surrounding area were erected prior to the Zoning Ordinance and are on substantially smaller plots. As stated previously~ the lot has a depth of a little over 400 feet~ the result being that this land cannot be economically used for agricultural production because crop rows on the Petitioner's farm to the south are planted in an east/west direction~ Due to the proximity of Cox"s Lane and the woodland~ it is difficult to efficiently irrigate the crops and to spray the crops by air~ 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the surrounding area as shown on Exhibit 3 is "A" Residential and Agricultural and the use proposed is the erection of a one-family residential dwelling on the plot to be divide~.
