After investigation and inspection the Board finds that the
applicant requests permission to set off lot with existing building,
west side Nassau Point Road, east side Wunneweta Road, Cutchogue,
New York. The findings of the Board are that the lot to be created
would be undersized in a recommended low density area. Two water
studies, a general sutdy by Malcolm Pirnie of the Town of Southold
in June, 1967, and the Suffolk County Board of Health 1971 survey
of Nassau Point in particular, updated to 1975, emphasize the finite
nature of the available water supply which is replenished solely by
rainfall. In 1975, 80% of the wells showed evidence of salt water
intrusion according to the Board of Health letter of March 4, 1977,
which indicates that there is no change in the 1975 test results.
The creation of such a lot would set a precedent for the division
of many lots which are somewhat over 40,000 sq. ft. in Nassau Point
but not large enough for two lots. Many single and separate un-
developed lots on Nassau Point, some undersized, remain to be de-
veloped and should have prior rights to the available water.
The Board finds that strict application of the Ordinance
would not produce practical difficulties or unnecessary hardship;
the hardship created is not unique and would be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will change the char-
acter of the neighborhood, and will not observe the spirit of
the ordinance.

A variance to the Zoning Ordinance is requested for the
reason that the present property ef eno and one-D~lf acres
is ~oo extensive to maintain as a private residence. Since
it is the intention of the applicants to offer the property
for lease, it would be more economically and physically
manageable if permission is granted to split off approx-
imately eno-half acre {22~585 sq. ft.) as a sep~ate, single
residence building plot.
Strict application ef the Ordinance would produce diffi~
cutties or up. necessary hard~ip because cf the problem cf
realizing, on a lease basis, a fair re~rn on ~nvestment
as the property new exists. The granting of the requested
variance would enable the appi$o~a~.te to split off and offer
for sale a single residence bu~ld~ng lot, one-half acre in
size ~ud fronting on Wunneweta Road. The residual property
of approx~mateiy one acre (46,950 eqo ft.) which fronts on
Nassau Point R~ad could then be offered for lease on a more
equitmble basis. The consequent reapportionment of taxes
between the indicated properties would offer economic relief
in accordance with projected use.
The hardship created is unique ~0.d is net shared by all
properties alike in the immediate vicinity of this property
and in this use district because the majority of the nearby
properties are inferior in size to the presently existing
property amd several adjacent properties are smaller in
total area than the subject lot indicated in the variance
request.
The variance would observe the spirit of the Ordinance ~nd
would not change the character of the district because the
subject lot described in the request is equal to or larger
in area than several other nearby properties and the existing
character and image of the district is similar to the applic~
~nts~ proposed use as a single residence building site. The
residence on the resid~l property en Nassau Point Road is
set back approximately 150 feet from that Read~ Its status
as e single family dwelling would also be maintained. The
variance request is in keeping with the principle inherent
in ~oning appeals precedure~ that is, to provide individual
relie~ in situations where broad changes in zoning laws may
cremts specific hardship and inequity.

As you will probably recall, members of our Association have often
appeared before your Board in the interest of preserving the tenuous
water supply on Nassau Point. These appearances have been in connection
with subdivision of properties and the installation of swimming pools.
In the past the Association itself, while encouraging active participation
in these hearings by its members, did not take an official stand.
Because of our continuing concern about water and the increase in requests
to your Board to allow variances which would further reduce our supply,
the Board of Directors of our Association passed a resolution which
provides that our Association will officially object to the granting
of any variances that will result in any lot being less than one acre~
For this reason, we wish to express our deep concern over the variance
reouest at next Thursday's meeting to divide Mr. Baglivi's plot of
1.~ acres into three lots. 1]?e strongly support the present zoning
regulation of one acre plots and in spe~ing to my friends and neighbors
they have all expressed their fear of any such subdivision and its
effect on our ~ater supply and consequent property values.
I believe there is strong precedent for your Board to deny this r~quest.
In 1977, an application for a variance was made to your Board to aivide
a similar lot ( Lot 141 on the Nassau Point map~and then owned by
Mr. Arnold Gardner) into les~ than one acre lots a~d your Boa~ wisely
denied the request on the baois of our water supply problems. ~e
earnestly request that you deny the current application.
On the matter of the swimming pool, our Association and a large majority
of our members are opposed to the construction of pools because of
their effect on our water supply. With beaches and beautiful Peconic
Bay within a short distance of any home on the Point, it is hard to
understand anyone wanting to mar the landscape with a pool. We also
wish to register our protest on this application and hope that you~
deny it.
We greatly appreciate the work your Board is doing and we wish to
support your efforts to enforce the Zoning Code and the beauty and
health of this area.

Dear Ms. Dawson:
Your letter of 2/28/77 to Mr. Robert Villa of this office has been
referred to me.
The Department of Health Services has conducted several surveys of
the Nassau Point area, the most detailed of which resulted in the
1971 report which we have enclosed for your reference.
! have also enclosed a copy of the most recent samplings performed
in 1975. While no statistical comparison can be drawn between these
samples and those summarized in the survey report, the results do
demonstrate that the same basic quality problems still persist. The
conclusions drawn in the 1971 report therefore are still pertinent.
One point of clarification should be made with respect to the most
recent samples. The analysis for these samples was expanded to in-
clude copper and zinc. The presence of copper and zinc indicates the
occurrence of corrosion of copper and galvanized piping, respectively.
Such corrosion is, in turn, due to the natural acidity of Long Island
ground water. The presence of these corrosion products are not
thought to represent a health hazard, although aesthetic effects may
occur.

It has recently come to our attention that the General Engineering
Unit of the Health Department has, in the past, conducted studies
of the water supply on Nassau Point, Cutchogue.
There is now an application before the Board in which this type
of information would be most helpful. Therefore, please send us
any studies or other information you have pertaining to the water
situation on Nassau Point.

Only one shallow well appeared to be receiving deirect cesspool leach-
ings.
There was no evidence of detergent in the aquifer except in the
aforementioned case.

were not found in a specific

balance in the area between the salt and fresh watar. Certainly a~ny

generally low concentrations can be attributed to seasonal population

fluctuation and the samll percentage of land receiving fertilizers.
The iron concentrations in excess of standards were probably caused
by well inactivity, plu~nbing or the well casing.s.
Conclusions

additional 30% had chloride levels in which differelt~atie'l
between salt intrusion and cesspool pollution could not be
actually determined. Eighty percent of the homes are thus
experiencing chloride levels in their water supply greater
'{han normal accepted ground water concentrations although
none exceeded drinking water standards.

Prevent any dredging of the shoreline
If the condition of the ground water shows deterioation, a
central water supply for_t_b~¢_ penin~.a should be established
to provide managelaent of the resource. Controlled move-
ment of the salt water interface could thus be achieved.
4. The feasibility of connecting to a central mainland public
supply should be studied.
