By resolution of the Board it was determined that (a) Strict appl/cation of the Ordinance (would) (would not) produce practical hardship because SEE REVERSE difficulties or unnecessary (b) The hardship created (is) 0s not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE FORM ZB4 ~ of~ppeal$ ZONING BOARD OF APPEALS After investigation and inspection, the Board finds that the applicant requests permission to construct dwelling with insuffi- cient setbacks, north side CR27, Greenport, New York. The findings of the Board are that the Board is in agreement with the reasoning of the applicant. Due to the close proximity to Long Island Sound, it is necessary to locate the dwelling closer to the road, as most all other dwellings in this area are located. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the i~unediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, James W. Dawson, 9 Stone Ledge Road, Upper Saddle River, New Jersey, be GRANTED permission to construct dwelling with insufficient setbacks, north side CR27, Greenport, New York, as applied for. STRICT APPLICATION OF THE ORDINANCE would produce procticoldifficultiesorunneces- sary HARDSHIP becau~ the applicant would be unable to consummate an existing contract of sale for the purchase of the property upon he wishes to construct a residential dwelling. This particular property has been held in single and separate ownership since November 29, 1960. If this Board fails to grant the variance requested, it can only re- sult in making the p'roperty totally valuelem both as to the applicant and the present owner thereof. There has already been secured from the Department of Environmental Conservation approval to construct a residential dwelling on said property. There is now pending before the Suffolk County Health Department approval of both sewage and water systems, & determination of which should be made by the time this application is heard. There is annexed to this application a guaranteed survey of the premises for which the variance is sought. There has been spotted on the survey the approximate size and location of the proposed resLdential dwelling. To deny this application would be to totally dis- regard the substantial practical difficulty faced by both the applicant and the present owner in utilizing the property as a permitted use under the Southold Town Zoning Ordinance. 2.
