After investigation and inspection, the Board finds that the
applicant requests permission to divide property with insufficient
width and area, Minnehaha Boulevard, Southold, New York. The
findings of the Board are that the Board is in agreement with the
reasoning of the applicant. Many lots in the surrounding area are
smaller than the lots to be created.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will not change the
character of the neighborhood, and will observe the spirit of
the Ordinance.
THEREFORE IT WAS RESOLVED, Elizabeth A. Yaro, P.O. Box 1221,
Minnehaha Boulevard, Southold, New York, be GRANTED permission to
divide property with insufficient width and area, south side
Minnehaha Boulevard, Southold, New York, as applied for, subject
to the following condition:
This lot shall_not be divided into two lots unless the
applicant is able to receive Board of Health approval
for the water and sewage.

Dear Mr. Villa:
At the present time, Mrs. Yaro has an application before the
Board for permission to divide property on Minnehaha Boulevard
in Southold. The Board would like.to know the Health Department's
opinion on this matter, and if the Department would issue permits
for wells and cesspools should the property be divided.
Enclosed please find copies of the application, the County tax
map, the Van Tuyl survey of the property, and letters from the
Suffolk County Planning Commission and the N.Y.S. Department of
Environmental Conservation.
Any information you can give us will be greatly appreciated.

D~ar Mrs. Yaro:
We have inspected your property on the south side of Minnehaha Blvd.,
Southold on Corey Creek. The westerly parcel is cleared and contains an
irregular shaped bulkhead and dock. Some marsh grass is located along the
periphery of the land. The easterly lot is covered with Phra~mites, the
high reed which is a non-protected species. The periphery of the lot along
the water contains a viable marsh 5' - 15' fringe of Spartina alterniflora,
a protected species, with no bulkhead. As this area appears stable, we
would not want to see bulkheading in this area.
Under the present moratorium regulations, we do not require permits
for subdivision of lots. It should be noted, however, that under the final
land-use regulations which we expect to become effective shortly, these lots
which are approximately 1/3 acre would not meet minimum size requirements
of 40,000 sq. feet (part 661.6 (5) (ii)). As these are not yet in effect,
we cannot oppose subdivision at this time.

Pursuant to the requirements of Sections 1323 to 1332 of the Suffolk
County Charter, the above captioned application which has been referred
to the Suffolk County Planning Com~ission is considered to be a matter for
local determination. The decision of local determination should not be
construed as either am approval or a disapproval.
Comments: Subject to compliance with any conditions set forth by the New
York State Dept. of Environmental Conservation. Division of the premises to
allow the'erection of two dwellings appears inappropriate considering environ-
mental constraints.
