By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties or unnecessary SEE R~VERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( that the previous decisions of the Building Inspector FORM ZB4 ) be granted ( ) be confkmed ( ) be reversed. The findings of the Board are that the Board is in agreement with the reasoning of the applicant. Many lots in the surrounding area are smaller than the lots to be created. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. The Board would like.to know the Health Department's opinion on this matter, and if the Department would issue permits for wells and cesspools should the property be divided. Yaro Minnehaha Blvd., P.O. Box 1221 Southold, NY 11971 Re: TW 15276-0224 D~ar Mrs. Yaro: We have inspected your property on the south side of Minnehaha Blvd., Southold on Corey Creek. The westerly parcel is cleared and contains an irregular shaped bulkhead and dock. Some marsh grass is located along the periphery of the land. The easterly lot is covered with Phra~mites, the high reed which is a non-protected species. The periphery of the lot along the water contains a viable marsh 5' - 15' fringe of Spartina alterniflora, a protected species, with no bulkhead. As this area appears stable, we would not want to see bulkheading in this area. Under the present moratorium regulations, we do not require permits for subdivision of lots. It should be noted, however, that under the final land-use regulations which we expect to become effective shortly, these lots which are approximately 1/3 acre would not meet minimum size requirements of 40,000 sq. feet (part 661.6 (5) (ii)).
