BOARD OF APPEALS
be denied and
After investigation and ~nspection, the Board finds that the
applicant requests permission to re-align lot line, south side Main
Road, Peconic, New York. The findings of the Board are that the
Board is in agreement with the reasoning of the applicant. The
Board is not really creating new lots but recognizing existing
residences on the appropriate lots.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
th~ hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will not change the
character of the neighborhood, and will observe the spirit of
the Ordinance.
THEREFORE IT WAS RESOLVED, Adolph G. Westerlund, Main Road,
Peconic, New York be GRANTED permission to re-align lot line,
south side Main Road, Peconic, New York, as applied for.
Vote of the Board: Ayes: - Messrs: Gillispie, Bergen, Hulse,
Grigonis.

REASON FOR APPEAL

I. STRICT APPLICATION OF THE ORDINANCE wou~d produce practical difficulties or unneces-

frontage portion ~nd deprives apptzcan= from +
pie-shaped parcel to applicants home property owned by applicant and
wife~
2. The hardship created is UNIQUE and is not shared by all prope~ies alike Jn the knmed[ate
vicini~ of this propeRy end in this use district because premises of other ~ners in
vicinity consist of either si~.ilar sized plots or unimproved areas
of farm land.
3 The Variance wouJd obse~e the spirit ofthe Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DiSTRiCT because the ant±re tract presently consists of
two undersized lots and after the transfer, there would remain ~o
undersized residental plots~
