Location of property: south side Main Road, east of Skunk Lane, Cutchogue, New York, bounded on the north by Main Road (Route 25); east by Horton; south by Horton; west by $chaumann. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because difficulties or unnecessary SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( that the previous decisions of the Building Inspector ( ) be confirmed ( SEE REVERSE FORM ZB4 ~O~G ) be granted ( ) be reversed. BOARD OF APPEALS ) be denied and After investigation and inspection the Board finds that the applicant requests permission to operate a used car sales lot, south side Main Road, east of Skunk Lane, Cutchogue, New York. The findings of the Board are that a used car lot, under the bulk requirements of the present Ordinance, requires a 30,000 sq. ft. lot. The applicant's lot is approximately 16,200 sq. ft. in size. The proposal is to use the premises principally as a holding lot for used cars to be driven elsewhere by drivers. The lot might occasionally be used for the sale of cars from the prem- ises and the residence might be used by the owners and/or drivers, thus involving both a residential and a business use on premises which are insufficient and undersized for either use. Of the several uses permitted in the "B-i" district, the used car business probably requires the most space and is the least desirable aesthetically, as well as contributing to the deterioration of property values. The property across the street is zoned "Residential-Agricultural." The applicant proposes a basic use which is the wholesale storage and sale of used cars. However, the applicant testified that the probable, principle use would be the storage of used cars until transferred to the appli- cant's wholesale yard. Wholesale storage is a permitted use in the "C-Light Industrial" district. The Board finds that the public convenience and welfare and justice will not be served and the legally established or permitted use of neighborhood property and adjoining use districts will be permanently or substantially injured and the spirit of the Ordi- nance will not be observed. Horton We are strongly opposed to th~s application for a used car salew lot next to our property. We feel the lot is entirely too small for such a business. Also,we do not wish to see an area such as this develope into one like those up the island where garages and used car lots take up the whole landscape. If the Board allows this business over the objections of the two adjoining property owners as well as those of several n~arby owners;I would like to suggest that restrictions be placed on the owner. These could include, limiting the number of cars on the lot at one time to 6 to 8 and requiring a suitable fence attractive to the neighbors,hiding the unattractiveness of the business and any others the Board feels necessary. Schaumann,s place of business and Ted's Auto Body Shop, in my opinion this would be a detri- ment to the community. I strenuously object to your granting this man permission to use this property as a used-car lot. We Nassau Point residents treasure the residential- farmland nature of the Cutchogue-Peconic area, an import- ant part of which is the lack of concentrated commercial development along the main highway. Main Road is, of course, the major arterial highway traversing the North Fork and serious considera- tion should be given to the uses permitted on this thoroughfare. The area which is the subject of this application is now primarily farm land, rural in character, and even if it were to be utilized for business purposes, sound planning could be dictated as to those uses which would be consistent with the character of the community. A proliferation along Main Road of gasoline service stations, used car lots, etc., would do nothing more than create along this beautiful thoroughfare, a duplication of Sunrise Highway as it currently exists in Suffolk County. I am sure, this is something we wish to avoid. Thank you for giving this matter your consideration.
