SPECIAL EXCEPTION. By resolution of the Board it was determined th~ a special exception ( ) be gra~ed ( ) ~ de~ed pursuant ~ ~tic~ .................... ~ct~n .................... S~se~ion .................... paragraph .................... of t~ Zoning Ordinance and the decision of the Bufld~g I~pector ( ) be reversed ( ) be co~irmed b~a~e 9:05 P.2. (E.S.T.) upon applicat±on of Valentine W. and Sophie K. Stype, Mattit~ck, New York for a variance in accordance with the Zoning Ordinance, Article XI, Section 100-118 for permission to construct addition with insufficient side-yard setback and off-street parking. Location of property: north side Main Road, Mattituck, New York, bounded on the north by Mattituck Park District; east by William Wickham; south by Main Road; west by M. Kelsey Properties, Inc. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because SEE REVERSE practical difficulties or unnecessary (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the sp~it of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( that the previous decisions of the Building Inspeeto{ ( ) be cor~firmed ( ) be reversed. //~1_~_-- ZONING BOARD OF ~PE~S ) be denied and After investigation and inspection, the Board finds that the applicants request permission to construct addition with insufficient side-yard setback and off-street parking, north side Main Road, Mattituck, New York. The findings of the Board are that the Board is in agreement with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Valentine W. and Sophie K. Stype, Mattituck, New York, be GRANTED permission to construct addition with insufficient side-yard setback and off-street parking, north side Main Road, Mattituck, New York, based on the revised site plan approved by the Planning Board on November 21, 1977, subject to the following condition:~ The applicants shall provide at least seven additional parking spaces on the northerly end of their property. The applicant will determine the type of surface based on the drainage problems in the area and will assure that the site will be self-contained as to drainage. No water from this site shall drain onto properties located either to the east or west of this property. Vote of the Board: Ayes: - Messrs: Gillispie, Bergen, Hulse, Grigonis, Doyen.
