2. VARIANCE. By resolution of the Board it was determined that

ZONING BOARD
After investigation and inspection, the Board finds that
the applicants request permission to divide property with in-
sufficient width and area, northwest side of West View Drive,
Mattituck, New York. The findings of the Board are that the
Board is in agreement with the reasoning of the applicant.
The Board finds that strict application of the Ordiaance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will not change the
character of the neighborhood, and will observe the spirit of
the Ordinance.
THEREFORE IT WAS RESOLVED, Frank and Vera Scott, West View
Drive, Mattituck, New York, be GRANTED permission to divide prop-
erty with insufficient width and area, northwest side of West View
Drive, Mattituck, New York, as applied for.

A Variance to the Zoning Ordinance

July 15, 1964~ creating one lot with 21,271 square feet and one lot with
26,567 square feet of upland and 11,300 square feet of filled area.

1. STRICT APPLICATION OF THE ORDINANCE wouid produce practical d~fz~cu t~es or unneces-
sary HARDSHIP because applicants purchased the property as two separate
lots and now wish to sell the easterly lot on the corner. The com-
bined size of the two lots is extremely large in comparison to the
rest of the neighborhood. Since the house is situated on the west
lot with a large yard on the creek sided the east lot is an unnec-
essary adjunct to the west icrc The east ~ot is at a higher ele-
vation than the west lot and is ideally suited for a separate Duildw
lng lot. Although the proposed division would leave 28 feet in
total side yard on the west lots this is characteristic of the
neighborhood°
2. Tbe hordshipcreotedis UNIQUEand isnotshared by all properties ali~ in the immediate
vicinity of this property and in this use district because applicants property now con-
tains the largest area in the neighborhood. Most of the lots along
West View Drive have a frontage of 75 feet or less and an area of
well under 20,000 square feet. The property im~ediate!y to the
west has a 65 foot frontage and an area of only about 15,000 square
feet. The attached copy of the real property tax map sh~ws the
size and location of the lots in the neighborhood.
3. The Variance would observe the spiri~ of ~he Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because all of the lots in the neighborhood~
except applicantsl are undersized~ and almost every lot has a house
on it. The property across the Anchorage to the north is a recrea-
tional area and would not be adversely affected by the division°
