By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (wodid not) produce hardship because SEE REVERSE practical difficulties (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properHes alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( that the previous decisions of the Building_ ,r//In~'ect°r ( ) be confirmed ( ) be reversed. / ) be denied and After investigation and inspection, the Board finds that the applicant requests permission to divide property and construct dwelling on lot with insufficient width and area, east side Bray Avenue, Laurel, New York. The findings of the Board are that the position of the houses on the lots in that block, as far as can be determined, and the fact that Mr. Schonewald bought these lots before Zoning legitimately believing he had two lots, should have some bearing on this application. Also, practically all of the lots across the street are 50' lots. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, William J. Schonewald, Box 23 A Route 1, Wells Road, Mattituck, New York be GRANTED permission to divide property and construct dwelling on lot with insuffi- cient width and area, east side Bray Avenue, Laurel, New York, as applied for. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIPbecause the owner at the time of buying the northeast lot could not purchase the southeast lot because Mrs. Tuthill had a deposit on it. After having built the house, Mrs. Tuthill informed me that it was available and I purchased it. My son and his wife now live in the house on the northeast lot. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because I now have a daughter who is planning to get married and I would like to build a small (25' wide x 38') Cape Cod house on this vacant lot for her. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the district is comprised of quite a few small lots of this size, many of which have houses built on them. I therefore do not believe this variance would change the district's character.
