After investigation and inspection the Board finds that the
applicant requests permission to divide property with insufficient
area, south side Pinetree Road, Cutchogue, New York. The findings
of the Board are that the application is self-explanatory, and it
was not necessary for Mr. Scherz to be present. Most of the lots
in the area are smaller than the two lots to be created.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will not change the
character of the neighborhood, and will observe the spirit of
the Ordinance.
THEREFORE IT WAS RESOLVED, Henry C. Scherz, 37 Lotus Lane,
Westbury, New York be GRANTED permission to divide property with
insufficient area, south side Pinetree Road, Cutchogue, New York.

The Board felt that it was not necessary for you to
be present as your request was a reasonable one in

the immediate vicinity are smaller than the two lots
to be created.
