By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties or unnecessary SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) ehange the character of the d~trict because SEE REVERSE (would not) and therefore, it was further determined that the requested variance ( ) be granted ( that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. The findings of the Board are that the Board is in agreement with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. The Chairman opened the hearing by reading the application for a variance, legal notice of hearing, affidavits attesting to its publication in %he official newspapers, and disapproval from the Building Inspector. The Chairman also read statement from the Town Clerk that notification by certified mail had been made to: John LeViness; Allen T. Schwab. Fee paid $15.00. THE CHAIRMAN: The blueprint which was submitted with this application is by Van Tuyl surveyed March 20, 1973. The property is on Pine Tree Road and somewhere I have a note here that this is about 52,000 sq. ft., is that correct? EDWARD ROBEDEE: No, that would be 17,000 sq. ft. THE CHAIRMAN: No, the whole property. EDWARD ROBEDEE: It's 1.59 acres. THE CHAIRMAN: it was. 69,260 sq. ft., that's larger than we thought EDWARD ROBEDEE: It's approximately an acre and a half, plus.
