REASON FOR APPEAL
A Variance to Section 280A Subsection 3
(X} A Variance to the Zoning Ordinance

is requested for the reason that applicant is the owner of land and dwelling on the East side
of Montauk Avenue comprising 1.70 acres. Applicant proposes to sell portion of
premises fronting on Montauk Avenue, together with dwelling and garage containing
1.05 acres, and to retain vacant land containing 1. 65 acres having a frontage of 95.84
feet on Sterling Street. The parcel to be retained complies in all respects with the
Toning Code except that it will have a frontage of less than that required by the

Zoning Code. A map showing the 1.05 acre parcel to be sold and the 1.65 acre parcel:
to be retained (outlined in yellow) is attached hereto.
REASON FOR APPEAL Conrinued
i. STRICT APPLICATION OF T9-IE ORDINANCE wouEd produce practical difficuEties or unneces-
sary HARDSHIP because as indicated on the attached map, both the parcel to be sald and
the parcel to be retained exceed an area the minimum area required by the Zoning Code
However, it is impossible to davide the parcel into two lets without one of the lots
having a street frontage of less than required by the Code. To deny this area variance
would foreclose the applicant from dividing this property, thus imposing an economic
hardship on applicant since the property has a value of 25~'/o more if divided into two
Lots than if retained as one large oversized tract,
The hardship created is UNIQUE and is not shared by ail properfies allF<e In the immed'oate
vicinity of this property and in this use district because none of the lots in tFse neighborhood
are so circumstances as to contain an area in excess of the Code requirements
but a street frontage of less than the code requirements,
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the granting of a variance as requested will .not
increase the density above that specified in the Zoning Code since each resulting
lot will exceed the area requirements of the Zoning Code.

YOU ARE HEREBY GIVEN NOTICE:
1. That it is the intention of the undersigned to petition the Board of Appeals of the Town of Southold
to request a (Variance) (~®alx~~x~(~~ra~oil~~~'a
1.
2. That the property which is the subject of the Petition is located adjacent to your property and is des-
cribed as follows: Northerly by lands of Doroshevich, Hedge and West Harbor; Easterly
by lands of Porter, Torrance and Sterling Street; Southerly by land of Elwell; and
Westerly by other land of Applicant, containing 1.65 acres.
3: That the property which is the subject of such Petition is located in the following zoning district:
"A" Agricultural and Residential
4. That by such Petition, the undersigned will request the following relief: A variance to reduce
frontage on Sterling Street from 150 feet to 95. 85 feet.
5. That the provisions of the Southold Towri Zoning Code applicable to the relief sought by the under-
signed are: Bulk and Parking Schedule and Section 100.-31.
6. That within five days from the date hereof, a written Petitiorr requesting the relief specified. above will
be filed in the Southold Towh Clerk's Office at Main Road, Southold, New York and you may then.and there
examine the same during regular office hours.
7. That before the relief sought may be granted, a public hearing must be held on the matter by the
Board of Appeals; that a notice of such hearing must be published at least five days prior to the date of such
hearing in the Suffolk Times and in the Long Island Traveler-Mattituck Watchman, newspapers published in the
Town of Southold and designated for the publication of such notices; that you or your representative have the
right to appear and be heard at such hearing.
