D. 2, Box 143, Flanders, New Jersey for a variance in accordance with the Zoning Ordinance, Article III, Section 100-30, 31 and Bulk Schedule for permission to construct addition with insufficient side and rear yard setback. Location of property: Halyoke Road, Orient, New York, bounded on the north by Plain Land Realty; east by Berks; south by Halyoke Avenue; west by Meyer. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because SEE REVERSE (would not) and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector (.) be confirmed ( ) be reversed. After investigation and inspection, the Board finds that the applicants request permission to construct addition with insufficient side and rear yard setbacks, Halyoke Road, Orient, New York. The findings of the Board are that the applicant has an extremely un- usual hardship in that the residence is located in the far northeast portion of an approximately 70,000 sq. ft. lot. The use of solar panels aligned with the roof of the proposed addition require further violation of the rear yard area. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, John C. and Doris B. Morgan, R. D. 2, Box 143, Flanders, New Jersey be GRANTED permission to construct addition with insufficient side and rear yard setback, Halyoke Road, Orient, New York, as applied for, subject to the following condition: This lot shall not be further subdivided. Due to the ¼sual placement of this residence on said property, applicants are mnable to add, a badly needed garage and storage area to their house without violating side yard set- back requirements. ~orm (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE Would produce practica] difficulties or unneces- sary HARDSHIP because app!ieants~ residence is sibuated on their property in such a manner as to presently provlde only a t5 foot .... ~ ~rd and a ~O foot side yard to the northeast and northwest of said residence~ Applicants have explored the possi- bility of moving said residence so as to locate it more centrally on their properLy~ but have ~en informed that due to the age and type of construction of said resi~ dense that such a moYe would be problematic and u~duiy e×pensive~ Since the afore~ mentioned proximity to the lot lines precludes construction at right and!es to the existing residence on tMe northeast and northwest sides~ and sines any similar struction on the southeast or southwest side of the house would effectively block access to and view of the frontal aspects of the residence~ applicants are £aoed with no alternative but to situate their needed garage and storage area at an proximate ~ degree angle to the west of the e×is¢ing struc~ure~ Zn addition to allowing utilization of an harmonious architectural style for this new area~ app!i~ ca.ts~ planned extention would provide an ai!~im~or~t southerly orientation for the garage roof allowing an ideal p!aeemen~ for app!isanzs~ planned solar energ%- collection 2. The hardship created is UNIQUE and is not shared by afl properties alike in ti~e fmmedJate vicinity of this property and in this use distric~ because of the aforementioned z~usual and hi~hty unfortunate ptaeemenv of app!icants~ residence on their pro~rty~ Were it not for this fac%or~ and the relative impessibiiity of moving this house to a locatlon~ applicants would be able to utilize the vast open area of ~heir property without need for a Variance° 3.
