After investigation and inspection, the Board finds that the
applicant requests permission to construct dwelling with insuffi-
cient side-yard setbacks, south side South Lane, East Marion, New
York. The findings of the Board are that the Board is in agreement
with the reasoning of the applicant. This minor variation in the
side yards is not going to affect the safety, health, and welfare
of the Town of Southold.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will not change the
character of the neighborhood, and will observe the spirit of
the Ordinance.
THEREFORE IT WAS RESOLVED, Thomas L. Minnigan, 91 Princeton
Avenue, Hewlett, New York, be GRANTED permission to construct
dwelling with insufficient side-yard setbacks, south side South
Lane, East Marion, New York, as applied for.

three (3") inches for a foundation in an area where the surrounding
properties are at the present time improved parcesl of land with
one-family dwellings.
3. The Variance wouid observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the requested variance is for only
three (3") inches on both side yards. The requested variance wou~
not be perceptible to the naked eye.
In conversations with the adjoining landowners they have
indicated to me that they have no objection to the requested variance~

his recently constructed foundation for a one-family
dwelling. Said foundation encroaches three (3) inches

of the premises. I also enclose herewith a copy of a
survey for this piece of property.

surrounding property owners when I have received the

1. That it is the intention of the undersigned to petition the Board of Appeals of the Town of Southold

hearing in the Suffolk Times and in the Long Island Traveler-Mattituck Watchman, newspapers published in the
