By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (wou/d not) produce hardship because SEE REVERSE practical difficulties or unnecessary (b) The hardship created (is) (is not) umque and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( that the previous decisions of the Building Inspector ( ) be confirmed ( REVERSE /.~ JJ ~O~[.D ZB4 . 5 BOARD ) be granted ( ) be denied and ) be reversed. OF APPEALS After investigation and inspection, the Board finds that the applicant requests permission to conduct home occupation, north side Main Road, Cutchogue, New York. The findings of the Board are that this would not be a suitable occupation in a residential area due to the machinery used in the upholstery business as well as the inadequate nature of the lot. The lot is undersized. The Board finds that strict application of the Ordinance would not produce practical difficulties or unnecessary hardship; the hardship created is not unique and wuuld be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will change the char- acter of the neighborhood, and will not observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Joseph S. Czartosieski, RR1 Box 194A, Main Road, Cutchogue, New York, be DENIED permission to conduct home occupation, north side Main Road, Cutchogue, New York. Joseph Czartosieski's request that he be permitted to conduct an upholstery business in our residentially-zoned area. This brief hearing was adjourned to February 17. Because of plans made some months a~o, we are unfortunately unable to be present at this February 17th meeting, yet we wish to be certain our objections are re- corded and heeded. We believe the ~ranting of this request would be an infringement of the zoning laws resulting in a depre- ciation of our residential property on the ~ain Road and on ~lvah's Lane. Je believe that the granting of this variance would have practically the same effect as rezoning the property for business. We understand that the petition- er is pleading financial hardship. ~e wish to point ou~ that there are properties--both stores and houses--avail- able in the Cutchogue-Mattituck area, either for sale or for rent, that are already zoned for business. But even if such were not available, that would be no reason to grant this variance. To grant this variance would be to set a precedent that would very soon lead to the despoiling of a very attrac- tive and picturesque part of the ~ain Road and detracting from our lovely Village Green and Old House. Further, pro- liferatin~ business on the ~ain Road will lead to traffic tie-ups. Our J~ain Road will be less of a thoroughfare and it will take people longer to get to their east and west destinations. ~ain Road property that is residentially- zoned should be zealously guarded so that traffic problems will not be compounded.
