By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because SEE REVERSE difficulties or unnecessary (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( that the previous decisions of the Building Inspector ( ) be confirmed ( ) be granted ( ) be reversed. The findings of the Board are that the Board is in agreement with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Hon. Joseph R. THE CHAIRMAN: The County tax map indicates that the applicant owns two lots, ~17 and 18, certainly with more than adequate width, and that the mistake as to where the builder located the house was not caused by the small size of the lot. It appears to be' almost 200' and 240' in depth. Is there anyone present who wishes to speak for this application? (There was no response.) Anyone wish to speak against this application? (There was no response.) I think, myself, that this is a reasonable request. The house, it appeared to me that the house immediately to the east is less than 15' from the side line so this would not be un- usual for the neighborhood. After investigation and inspection, the Board finds that the applicant requests permission to construct addition with insufficient side-yard setback, Lupron Point Road, Mattituck, New York. The findings of the Board are that the Board is in agreement with the reasoning of the applicant.
