SEE REVERSEv �l ING BOARD OF APPEALS FORM Z134 I 'Ot : 06616 Cr2 ,j.,j; Boa After investigation and inspection, the Board finds that the applicant requests permission to construct radio and T.V. tower exceeding maximum height, right-of-way, east side Break- water Road, Mattituck, New York. The findings of the Board are that the Board received testimony, including letters from local Mattituck residents and the applicant as well as a letter from the Federal Communications Commission, on three occasions before reaching a decision - August 4, September 15, and October 13 , 1977. Most of the letters and testimony referred to interference: to television reception alleged to have been caused by the applicant. Some of this testimony was invali- dated by the fact that Mr. Bartra had disposed of his short wave transmission set last June. The applicant has constructed two towers with guy wires in his front yard area in excess of the permitted height of 18 ' . The Board notes that it is not competent to access the causes of interference. We have also noted a severe accident to a child running into a guy wire. The FCC letter indicates that, in general, the trans- mission of short wave signals from a high tower causes less local interference than similar transmission from a lower tower. We also find that Mr. Bartra has made a considerable effort to assist his neighbors to find the causes of poor re- ception on their television- sets which are served by individual aerials in an area where hills to the west reach a height of 160 ' and tend to make reception difficult. We are also aware of the contributions short wave transmission can make in emer- gencies, and that the applicant has ordered a new short wave transmission .set and free-standing tower. In view of the un- usual and unique nature of the circumstances, the Board finds that the following resolution will make the tower arrangement more compatible to and safer for the area. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. TkJEREFORE IT WAS RESOLVED, Gustav Bartra, 227E Breakwater Road, Mattituck, New York, be GRANTED permission to construct a free-standing tower exceeding maximum height, right-of-way, east side Breakwater Road, Mattituck, New York, subject to the following conditions : 1. All towers in the front yard must be removed within 60 days. 2. A 50 ' free-standing tower (no guy wires) may be con- structed in the rear yard area at least 50' from any property line. 3. The following transmitting and receiving antennas may be placed on the tower so constructed: no more than rwo kz1 11am aulj transmission antennas and no more RECEIVED AIS! This office has on record thousands of amateurs operating around the clock in one family homes and heavily populated apartment house areas. These residents living in proximity to the amateur station do not experi— ence any interference to television, standard and FM broadcast reception, or high—fidelity audio equipment. For your information, it is common knowledge in the radio communica— tion field that a transmitting antenna closer to the ground, will bring the radiation field closer to the majority of television and radio broad— cast receivers in the same area, resulting in interference problems that would not be evident with a properly instal outdoor antenna. The ideal condition is, therefore, to erect the amateur's transmitting antenna in the clear, outdoors and as high as possible in an effort to physically and electronically remove the radiation field from the immediate environment of television receivers operating on weaker signals, due to lower antennas. Amateurs are assigned frequencies within bands, none of which are on or near the television channels assigned to New York City and vicinity. Licensees are required to operated their transmitters in conformity with the rules and regulations and when so operating do not cause interference to other radio services, provided the receivers in other radio services have adequate selectivity usually accomplished through proper filtering. Although no amateur, or for that matter, the licensee of any radio station, is required to furnish or install filters in television receiv— ers lacking adequate selectivity, many have shown a cooperative spirit which is indeed commendable and a credit to the amateur fraternity. -2- Robert W. Amateur radio stations when operated in conformity with the F.C.C. rules and regulations do not normally radiate any signals capable of in- terfering with television, standard AM or FM broadcast reception or any other radio service. Dear Sirs: On August 4 and September 15, 1977, the above applicant appealed to this Board for permission to retain two towers whose height ex- ceeds our Town 's maximum of 18 ' for accessory structures. Because of hilly terrain, one of these towers, used for radio transmission, is approximately 60 ' in height. The other tower, used for T.V. reception, is about 40 ' in height. Normally, the Board has granted height variances on towers used for television reception where a showing of hardship is indicated as a result of local topographical conditions and hilly terrain. At both public hearings there was strenuous objection by neighbors to excessive height for a radio tower. Neighbors claimed that the applicant' s voice was heard on their television sets along with picture distortion when the applicant used the FCC licensed radio for transmission purposes. The applicant claimed that lowering the radio transmission tower to our maximum structure height of 18 ' would increase rather than decrease television interference locally. Radio transmission is, of course, not covered by our local building - and zonina codes, and we have recessed the hearing until October 13, ecision. There is no real hardship in this case. 2. I and many other residents in the immediate area have been experiencing severe inteference of Television reception. It is very possible it is being caused by the existirg antenna's located on or near the petitioners property. 3. Many property owners residing in the area are retired, elderly, and in failing health, which forces them to remain at home. For thousands of television users who have their sets hooked up to antennae, the poor reception you have been getting on channels 2, 4 and 5 is the work of the sun. The phenomenon is called a skip condition,it is tied to sunspots, and its effects are felt worldwide. Sunspots are actually areas of the sun which for an unknown reason, become about 2,000 degrees cooler than the rest. When the spots occur, radiation is released, which can affect many things,including television reception. According to a spokesman at the Vanderbilt Planetarium, the spots are always occuring, but during the course of an 11 year cycle, their number peaks and lapses. The northern hemisphere is currently in a peak period,when there are more than the average eruptions. Dr. Gary Thomas, chairman of the Electrical Engineering department of SUNY at Stony Brook said, "The radiation is unpredictable and can do a lot of different things. if we are getting a bundle of low frequency radiation,it is possible that it would only be affecting the lower frequency stations like channels 2,4 and 5." The reason it interferes with reception is that the television is designed to receive the strongest signal, and if the sun's radiation is in the proper frequency and it can be stronger than local stations, leaving a TV watcher with a white screen, or ghosts of different stations. Mr. Peter Malone and Mr. Donald Cooper had already signed papers approving of my proposed tower,which I originally purchased for use mainly as a windmill generatorilater on,Mr. Donald Cooper told me That Mrs. Cannone opposed the windmill, therefore in order to please Mrs. Cannons I decided not to install the windmill and just file as a tower for radio use for which she told me she had no objections.However, after I filed.she did not only object to this also, but she succesfully convinced Mr.Donald CooDerls wife and Mr. Peter Malone to oppose me on grounds of televisions interference. It is a fact that we are all being affected by Ionospheric disturbances due to high sunspot activity which occurs every eleven years and lasts about one year. This disturbances affect all radio and television propagation during the day or night(Aurora Borealis happen at night due to sunspots) This problem Has been explained in some newspapers and magazines since it affects the entire World.This could easily be confirmed by calling the F.C.C.,Cablevision or any radio amateur. Since I am the only radio amateur in the vecinity,it has been easy for Mrs. Cannone to convince some people that I am the villain causing this interference. My wife and daughters are avid T.v. watchers and they would be the first ones to stop me from transmitting if I was causing interference. There are four LILCO poles right next to Mrs.Cannones property.and carry power and tel, cables, all of which Is in full view of her front door, and I believe my towers are better looking and are located 200 feet 0 from her house. There is always a slight possibility that a faulty radio transmitter may create interference,this also applies to CB radios which everyone seems to have one nowdays.however it would be absurd for me,as an electrical engineer,and a licenced electrician,and a licenced radio operator by the F.C.C.,to allow radio interference from my transmitter or not know how to correct< it. I always thought that my F.C.C. licence was the only licence I needed to install a tower.I had a radio tower in Melville L.I.for six years with no objections from the town or neighbors, until we moved to Mattituck where I had my towers already standing for five years with no objections from my neighbors until now. I know there are hundreds of radio amateur towers in L.I, and many of them in Southold Town without permits.prhaps due to the difficulty in obtaining one,We are all bound to run into a neighbor who will find any reason to object. It is also a fact that a high radio antenna lessens the chance of interference.this is one of the reasons why a high radio tower is part of the equipment of a good radio amateur. Mrs. Cannons is a N.Y. City resident at I250 Ocean Pkway, Brooklyn,N.Y.II230 nand operates her business next to my house for three months during the summer.As a sign of courtesy to her I decided to file for this permit when she is here in Mattituck, Perhaps it would have been better to wait until she went back home. When we moved to mattituck we learned to live with her business being next to us in spite of the things that they do in order to run thir business.It is not in my character to name my grievances,speeially since they do not have any bearing on this procedings. In spite of the several attempts I have made to gain the Cannones frienship without success,I am not sure weather this is due to my origin,race, or just to difference of interest,or perhaps a combination of those. 0 About the fact that I use my house to store some materials of my trade; which by the way has no bearings on this proceedings; to which Mrs. Cannone makes mention in her letter, I am willing to store my materials somewhere else,as soon I am given a satisfactory explanation from the board as to what is the reason Mrs. Cannons is allowed to run her business "Breakwater Cottages"in a an area zoned as Residential agricultural and I am not allowed even to store materials in my house while she is running a regular business with an outside telephone bell,a tool and equipment storage shed,having trucks delivering gas to each cottage and various trades continually coming to service utilities,having customers cars and boats in view of my front door,having customers play next to my property and sometimes cross my property etc. There are countless so small tradesmen like me in this area who use their homes for material storage and any of them would resent having their livelihoods ruined by a summer resident that comes to the area only to make money to take back to the city. Some of the accusations to which Mrs. Cannons refers to in her letter are incorrect, and it is easy to see that they are the product of a person who can store much resentment in her soul, and sincerely hope that she would open up to reason and sit down with me to iron out her grievances. Dear Sirs: On August 4 , 1977 , the above applicant appealed to this Board for permission to retain two towers whose height exceeds our Town' s maximum of 18 ' for accessory structures. Because of hilly terrain, one of these towers, used for radio transmission, is approximately 60' in height. The other tower, used for T.V. reception, is about 40 ' in height. Normally, the Board has granted height variances on towers used for television recep- tion where a showing of hardship is indicated as a result of local topographical conditions and hilly terrain. At the public hearing on August 4 , there was strenuous objection by neighbors to excessive height for a radio tower. Neighbors claimed that the applicant's voice was heard on their television sets along with picture distortion when the applicant used the FCC licensed radio for transmission purposes. The applicant claimed that lowering the radio transmission tower to our maxi- mum structure height of 18 ' would increase rather than decrease television interference locally. Radio transmission is, of course, not covered by our local building and zoning codes, and we have recessed the hearing pending receipt of a reply to this letter. We are hopeful that you can help us resolve the problem with particular reference to height of trans- mission tower and/or correction of the local interference caused by an FCC licensed station.
