By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties hardship because SEE REVERSE (b) The hardship created (is) (is not) umque and (would) (would not) be shared by aH properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( that the previous decisions of the Buil~ding ~l$1~e~e~r ( ) be confirmed ( ) be reversed SEE REVERSE /'~ r~\I/~Tg3~ ~ ' ) be denied and After investigation and inspection, the Board finds that the applicant requests permission to construct dwelling with insufficient side yards, west side Sylvan Drive, East Marion, New York. The findings of the Board are that the Board is in agreement with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, George and Minnie Baker, 83 Fenway, Rockville Centre, New York, be GRANTED permission to construct dwelling with insufficient side yards, west side Sylvan Drive, East Marion, New York, Lot 10A, Gardiners Bay Estates, subject to the following conditions: The applicant shall place his house no closer than 6' to either of the side lines and no closer than 25' from Sylvan Drive. Re: GEORGE BAKER application Keith Lyman, 7 Orchard Lane, Nanuet, NY 10954, called with regard to the Baker hearing. He had planned to attend the meeting tonight but something came up and he isn't able to eeme be here. Mr. Lyman owns the lot next to the Bakers, Lot llA. He is concerned about the parking for the lot (he says the street is too narrow to park on and wants to know if they'll have enough room on their lot) and he is also concerned about the drainage. Apparently, the Bakers' lot is flooded whenever it rains, and if they have to fill in order to build the house, Mr. Lyman is afraid the water will run onto his property.
