(E.S.T.) upon application of George Mahr, 19 Zemek Street, Valley Stream, New York for a variance in accord- ance with the Zoning Ordinance, Article III, Section 100-30 and Bulk Schedule for permission to change lot lines. Location of property: north side Front Street, Greenport, New York, bounded on the north by School District 910; east by now or formerly Peterson; south by Front Street (Route 25); west by W. Price. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because SEE REVERSE difficulties or unnecessary (b) The hardship created (is) (is not) umque and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because SEE REVERSE (would not) and therefore, it was further determined that the requested variance ( ) be granted ( that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSe. ZONING BOARD OF APPEALS ) be denied and After investigation and inspection, the Board finds that the applicant requests permission to change lot lines, north side Front Street, Greenport, New York. The findings of the Board are that the Board is in agreement with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, George Mahr, 19 Zemek Street, Valley Stream, New York, be GRANTED permission to change lot lines, north side Front Street, Greenport, New York, as applied for. Vote of the Board: Ayes: - Messrs: Gillispie, Bergen, Hulse, Grigonis, Doyen. F~rra (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical d[fficu[¢ies or unneces- sery HARDSHIP because any type of dividers be it a fence or shrubberyg erected on the current beundary line between the__ appellant~s prope_~yr~ and the property immediately to the west belonging to appeliant~s neighbor~ Kenneth Peterson, would be difficuit to ~ ~ To.ate because oflthe fact that the current boundary between the two properties is not a straight course° 2. The hardshipcreotedis UNiQUE and isnotshared by all properties alike in the immediate vicinity ofthis property and in this use disCrict because the property of appellant and ~t~e_above mentioned property, of Peterson are surrounded by property belonging~6 $chool~District NOo"i8 and Other property not use~ as pri~ate dwellings, and therefore, the boundary between appeltant's property and Peterson's preperty is unique in that aestketiC eensiderations normally associated with private family d~eltings prevail. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the ~esult of the c~nveyanee would be that the property of Petersen,~which has an area ~f less than ~8~000 square feet and is considerably smaller than the appellant!s prQperty~ would be e~larged and appeltant's property would be only slightly reduced and~ in addition, the area of appellant's land combined with the area of Peterson would remain the same with the only resulting change being a straight boundary lineo STATE OF NEW YORK ) ) ss cOUNTY' OF s~FFOLK) ./,..¢........'d....: Sworn to this ....................... day of .........Qg..~.Q.b..~¥ ............................... 19 77 olk County Department of Planning H.
