is requested for the reason that aDpl±cants wish to cl.±v±de the pro~erty ±~ accordance
with attached survey by Van Tuyl & Son, dated May 5, 1961, amended ~rch 3_,1977
and June 17, 1977, resulting in two undersized lots with insufficient front-
age and a third lot with access by a 25 foot right of way from Westphalia
Road. The property zs owned by Mary W. MacNish as life tenant and by her
daughter, Ruth Lessard, as remainderman, under the will of Ruth Satterly.

REASON FOR APPEAL
Continued
1. STRICT APPLICATION OF THE ORDINANCE wo~Id produce practiceJdifficu~tiesorunneces-
sary HARDSHiPbecause the total parcel contains about 3~7 acres~ but the lo-
cation of the existing buildings and structures on the property prevents a
reasonable division of the property into three lots of suffic±ent size and
frontage. However, both Parcels 1 and 2 have greater frontage and area
than any of the lots across the street. In 1962~ applicants obtaine~ per-
mission from the Surrogate to mortgage all but a small piece of Parcel 1
so Mrs. Lessard could convert the building on Parcel 1 to a residence°
Therefore, Parcel 1 has been effectively set off for many years~ although
remaining in single and separate ownership° Any division other than tka5
proposed would require relocation of the garage an~ ~riveway servicing the
house on the creek.
2. The hardshipcreatedis UN[QUEand isnotshared by all properties dike in the immediate
vicinity of this property and in this use district because this is the only parcel in the area
which has been partially mortgaged in this manners an~ because of the part-
icular location of the buildings.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the size of the Lessard lot would be about the
same as it has been since 1962, and in fact would have slightly more area
and frontage. The lot on the creek would remain large~ in keeping with
neighboring creek lots, while the two smaller lots on the road would be
closer in size to the lots directly across the street.
