ZONING BOARD OF A~PPEALS
After investigation and inspection~ the Board finds that the
applicant requests permission to construct addition with insuffi-
cient front and side yard setback~ east side ~oores Lane~ Creen-
port, New York. The findings of the Board are that the applicant
had a conforming use which burned down and which was replaced by
a conforming use which was changed to a non-conforming use when
the Ordinance was rewritten in 1971~ The Board is of the opinion
that it is better to vary the Ordinance in this case than it is
to change the zone to Light Industrial on property which is use~
for the storage of furniture~ household goods~ etc.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hards~ip~
the hardship created is unique and would not be shared by all
properties alik~ in the ir~uediate vicinity of this property and
· n the same use district~ and the variance will not change the
character of the neighborhood~ and will observe the spirit of
the Ordinance~
