After investigation and inspection, the Board finds that the
applicant reque:sts approval to subd.~.vi~de an excessively large parcel
of ~and ~nto three parcels. The findings of the Board are that it is
an excessive hardship to have a parcel of land with this size and
footage and frontage in the Town of Southold and that this will not
change the character of the neighboring district.
The Board finds that the public convenience and welfare and justice
will be served and the legally established or permitted use of neighbor-
boos property and adjo±n±ng use districts will not be permanently or
substantially injured and the spirit of the Ordinance will be observed.
Qn motion by Mr. G~ll~spie, seconded by Mr. Bergen, it was
RESOLVED that Robert Kowalski, Pine Neck Road, Southold, New York,
as agent for Stefania Zazeck±, be GRANTED permission to divide property
with insufficient road frontage. Location of property: Pine Neck Road,
Southold, New York, subject to the following condition:
The applicant receive the approval of the Planning Board to divide
parcel into three parcels, each of which will have more than 40,000
square feet. The westerly parcel will have 120 feet road frontage and
the remaining parcels will have 119 feet.
Vote of the Board: Ayes: Messrs: Gillispie, Bergen, Grigonis,
and Doyen.

Dear John:
As you know there has been difficulty in the past between the
Board of Appeals and Planning Board in the matter of dividing
three lot subdivisions because the Planning Board is not per-
mitted to create subdivisions where a~y of the lots do not
conform to the minimum standards.
Town Counsel has suggested in the above oaptioned matter that
the Board of Appeals hold a hearing. This hearing was con-
ducted last night, and the possibilities of how to divide a
parcel of 3.4 9ares with 358 feet of road frontage were dis-
cussed. The applicant proposes that the westerly lot have a
frontage of 120 feet and the two remaining lots equally divide
the remaining frontage.
Accordingly, we are suggesting this to you and perhaps you can
consider it at your June 5, 1978, meeting. Please advise us if
you have any suggestions which might differ from the applicant.

1. That it is the intention of the undersigned to petition the Board of Appeals of the Town of Southold

A-Agricultural Residential
4. That by such Petition, the undersigned will request the following relief:Road Frontage
Variance for three (3) lots.
5. That the provisions of the Southold Town Zoning Code applicable to the relief sought by the under-
signed are: Southold Town Code S10--3'1
6. That within five d'a~/s from the date hereof, a written Petition requesting the relief specified above will
be filed in the Southold Town Clerk's Office at Main Road, Southold, New York and you may then and there
examine the same during regular office hours.
7. That before the relief sought may be granted, a public bearing must be held on the matter by the
Board of Appeals; that a notice of such hearing must be published at least five days prior to the date of such
hearing in the Suffolk Times and in the Long Island Traveler-Mattituck Watchman, newspapers published in the
~[own of Southold and designated for the publication of such notices; that you or your represeutative have the
right to appear and be heard at such hearing.
