2. VARIANCE. By resolution of the Board it was determined that

After investigation and inspection, the Board finds that the
applicants request permission to construct an addition with
insufficient front yard setback, Bayview Drive, East Marion, New
York. The findings of the Board are that the Board is in agreement
with the reasoning of the applicant.
The Board finds that strict application of the Ordinance would
produce practical difficulties or unnecessary hardship; the hardship
created is unique and would not be shared by all properties alike
in the immediate vicinity of this property and in the same use
districts; and the variance would not change the character of the
neighborhood, and will observe the spirit of the Ordinance.
THEREFORE IT WAS RESOLVED, Mr. and Mrs. Charles Westenberg, 795
Bayview Drive, East Marion, New York, be GRANTED permission to
construct addition with insufficient front yard setback, Bayview
Drive, East Marion, New York, as applied for, subject to the following
condition:
The applicant shall not reduce the front yard setback to a
figure less than 27 feet.

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sory HARDSHIP because it would require the proposed extension to have an
off-set and would cause undue room layout of proposed extension.
2. The hardship created is UNIQUE and is not shored by all properties alike in the immediate
vicinity of this property and in this use district because of the irregular Shape of
the property.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because there are other residences in the
deveoopment that encroach on side and front yards. The area is
strictly residential and the residence to be altered and added to

Gentlemen:
With reference to the above application requesting a
variance, we submit pictures of the existing residence.
Picture #1 shows the front of the house from across the
street at Bayview Drive and Parsons Blvd.
Picture #2 shows part of the front of the house with the
proposed addition outlined in red.
Picture #3 shows the side and rear where the proposed
extension could be built.
Picture #4 is taken north of the existing residence on
Parsons Blvd.
Due to the irregular shape of the property and curveature of
Bayview Drive and Parsons Blvd. the proposed extension will
encroach on the thirty five (35') set-back. The proposed
extension will be screened out from view from Parsons Blvd.
