VARIANCE. On the east side of the building will be a room 20 feet by 25 feet. The Board finds that strict application Of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of the property and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. On motion by Mr. Gillispie, seconded by Mr. Douglass, it was RESOLVED that Richard Wall, 2715 Nassau Point Road, Cutchogue, New York, be GRANTED permission to construct an accessory building in the front yard area as requested. Location of property: Nassau Point Road, Cutchogue, New York, bounded on the north by Felix R. Palmeri; east by Little Peconic Bay; south by Bernard E. Goerler; west by Nassau Point Road, subject to the following: (1) The premises to be created consisting of a garage and two guest rooms and a cathedral ceiling living room shall not be leased or provided with cooking facilities. Under no circumstances shall a dwelling unit be created out of the combination guest house and garage. (2) Building shall be 3-1/2 feet from the southerly lot line and 100 feet from the property line on Nassau Point Road. (3) Building shall not exceed 18 feet in height. A copy of the decision taken from the minutes of November 9, 1978 is attached. This is the decision which will be approved at our next meeting on November 30, 1978, and formally certified to the Town Clerk. Our records indicate that the certified mail receipt shows the notice of hearing was mailed by the agent of the applicant to Mrs. Goerler on October 18, 1978, but that the notice itself dated by the appli- cant is November 16, 1978, an obvious error. The Town of Southold Zoning Ordinance, Section 100-25 A Notice of Hearing requires that the applicant notify adjacent owners as shown on the current assess- ment roll of the Town of Southold. In this case, the adjacent owner is Bernard E. Goerler, Nassau Point Road, Cutchogue, New York, as shown on the receipt for certified mail. Section 100-25 C states "Failure to comply with the provisions of this section shall not affect the validity of any action taken by the Board of Appeals." For the Board to rescind or reconsider or modify an action already taken requires a majority vote at a regular meeting and must be based on substantial information not previously known to the Board. The type of variance given to Mr. Wall has been granted in similar cases on Nassau Point and elsewhere in the Town where the applicant has virtually no legal rear yard area available for accessory buildings, due to waterfront locations. It is a privilege enjoyed by Mrs. Goerler also. Allen J.
